OH Calling me when on annual leave .

I spoke to ATOS last Friday and got told me report was being closed and would not be spoken to again till 3 weeks post op which I have in May . I have had to take annual leave to go on my 4 day holiday to Ayr so my sick will restart on Monday . Anyway I got a text fr my boss today to tell me someone from OH will be calling me at 2:30 today which I wasn't happy about when I'm on annual leave nothing from work should be contacting me ! The women from OH said ATOS didn't ask me the right questions so she has been asked to go over my file again and basically told me I've to go back to work before my op in 2 weeks time . To which I said I'm on holiday please call me back when I'm not !!! Raging !!!! Who thinks this is ok and fair ?

That's what I was told my sick would stop Saturday annual leave start Monday and sick restart next Monday .

No it's not 2 periods it just carrys on . It's the easy option to take time away whole off sick otherwise you need to get a letter from doctor or get OH to tell your boss your allowed to go .

I have never heard of that. Sick leave cannot stop and start. You are on sick or not. If not and your on holiday then you are no longer on the sick. It does become two absences, and "automatic" stage warning. What your are saying is I'm not sick so I can go on holiday. The correct procedure is to go through your doctor and OH.

Your dom is supposed to ask permission to refer you to oh assist not tell you they are calling. As for calling you whilst on annual leave, you should have been aware that was going to happen as when your dom asked your permission for them to call you, you should then realistically be expecting the call.

I would double check that because Im sure you have been told wrong. You have been off sick for 1 week then you've taken a weeks A/L so although you're not actually attending work they'll still class that as a working week. You're then going to be sick the following week so that would be classed as a 2nd absence because the absences were broken up with a scheduled week. If you're right and you've been allowed to do that then you have a very good and understanding DOM.

This was already answered under the previous posting of " SIGNED OFF BUT HOLIDAY NEXT WEEK" and if you wished to take the holiday break in Ayr to keep yourself in the clear by informing your DOM of your intention and be given permission to leave your home address where in Royal Mail Sick Pay Policy it is a condition for receiving wages while on sick absence.
Your DOM was being awkward and wanted a face to face meeting within the dates of your holiday break.
As you advised that OH Assist were leaving contact with you for 3 weeks until your op my suggestion was that you contact OH Assist and get their approval that your recreational break was for relaxation prior to your knee op and if accepted by OH Assist would allow you to take your holiday without using your annual leave entitlement and have the holiday days credited to you.
It know seems that this break will now be taken from your annual leave and in between dates on an active sick note and you now need to ensure that you have an assurance from your DOM in writing that this is acceptable and apart from the intervention of your holiday break this will be classed as a continuous absence for recording purposes.
If this has been agreed then your DOM should have contacted OH Assist with your referral reference and advised them of the dates you are on annual leave and no contact is to be made by them until your return to sick absence.
As previously advised you need to contact your union rep that the situation you are now in by the method you have chosen that you hold written confirmation from management or you could be on a sticky wicket.

Yes going off sick again for the op will go down as another sick absence but realistically with an 8 week recovery the fact it adds 1 more absence is irrelevant as the 8 weeks alone will trigger your next stage review

So presuming the individual is clear as regards stage warnings: Off on sick, resume on holiday, back sick equals stage 1. Off eight weeks for opp, stage trigger 2. Not far away from dismissal then......

You cannot have a holiday then go back on the sick, with no repercussions. The only agreement is you get your holiday back. Don't know were your getting your info from.

Shouldn't get two stages over this, it's all the same illness/injury in short space of time so normal practice is only to get one stage warning fir it (if warranted)
