Cutting off
Hi there was wondering exactly what the official procedure is if you don,t want to work any overtime or work through your break.the office where I work is completely taking the piss out of our good nature and is only going to get worse in the very near future.I would ask our union rep but........you know the rest !

1. Don't work through your break. You are usually entitled to 20 minutes in our office. Staff that don't take breaks to finish early bugger the job up for everyone else because its on this basis that managers are able to lapse more deliveries - giving everyone more work to do everyday.
2. You are not forced to work overtime. So when you know on any given day that you are going to be working past your time; just simply tell your manager that the work that you have got today will take you past your time and that you do not wish to work overtime. What can you do about it? It doesn't actually matter if it is the lapse bit that will take you past your time OR if its on your own delivery and you need some taking off. You don't need a reason why you only want to work the hours that you are paid for and you don't need to give them any 30 minutes / 1 hour flex either.
3. When faced with adversity or if the manager wants to play hardball about you not taking the collapse or whatever. If you can't speak to a rep on the shop floor, get in touch with the Area rep by phone. But as always, remember point 2 above. They cannot force anyone to work past their time.

I think postie45 means taking a 20mins break before going out on delivery and then a further 20 mins whilst out on delivery or tagged on the end

You CANNOT make an employee take a break at the end of a shift, it is AGAINST uk employment law, whatever RM say, end of.

For a statutory break you are 100% correct, for a contractual break its open to interpretation because it hasn't been tested as far as I know. For a FT member you can have 2 breaks - 20 minutes of each kind, or combine them to one 40 minute break (my recommendation).

Statutory break taken near middle of shift as possible
The contractual is a bugger as you can be told when to take it.
If I end up submitting an et1 it will be part of my case.
