We got told in WTL this week that the driver was responsible for making sure everyone wears their seat belts in the van.
We were told that the driver would be held responsible if the OP wasn't wearing the seat belt.
I thought that legally if the passenger is over 14 they are responsible for wearing the seat belts not the driver.

I mentioned this in the WTL but the manager just said Royal Mails policy is the driver is responsible.
Seems they are above the law.

Page 23,but that looks like it's for mini buses,and I vaguely rem that as a driver dropping staff off I had to tell them to belt up...Seat belts are also required in the rear of passenger-carrying
vehicles, and in most cases, the driver is responsible for ensuring
they are worn.

Seat belts are fitted to the front seats of all cars, light vans and large
goods vehicles manufactured after October 2001, and where fitted
they must be worn.

The law is if a patrol car stops two people in a car or van etc and the passenger is not wearing the seat belt then the passenger gets fined not the driver.

But from a h+s point of view RM is quite entitled to put the responsibility on the driver to ensure seat belt is worn, doesn't affect the law around it in any way just means the driver can be conducted if the passenger does not wear it. As for whether it's right for dom to be pushing this, that's a big no from me and I would recommend getting your rep to put a disagreement in over this

But surely because it's Her Majesty's mail all RM vehicles are exempt from all road traffic regulations.

My floater never wears his seat belt. It's always plugged in when I get into the van after he's been in it.
