attendance review

just a quick question .........
can a sickness be used again once it has been used for an attendance review 1. ?
the stage one had been closed after a clear 6 months, and now a manager is trying to use
the sickness again to issue a new stage one

Are you sure the stage 1 has expired as stage 1 formal prompt is for 4 absences or 14 days in a 12 month period If the stage 1 was still active and you had 1 absence or 4 days you would revert to a clear absence record because you have improved on the RM absence standard.
If manager is taking a previous absence into account then it would have to form a stage absence prompt so you will have to get in touch with HR for your absence record or if you have kept your absence history record that would have been sent to you when the stage1 was triggered then you will be able to calculate further absences before formal stages are issued.

the stage was triggered by one absent of 19 days in january, then there was 6 months clear and the stage closed. then 3 days was taken off.
the manager wants to count the 19 days and the 3 days to issue another stage 1. I cant see how than can use the same sickness twice, surely once the stage that the sickness was issued has been cleared then that sickness can not be used again

I have attached the above link for the new attendance agreement and guide you to No.3 in the Q&A part of this document.
Basically it states already on Stage 1 and Stage 2 review the next 6 months are fixed and no rolling period.
As you had 1 absence of 19 days in January 2014 resulting in a formal stage1 prompt and then 6 months clear from the date of your last absence then you should have been removed from the procedure.
Your additional 3 days of absence does not trigger a further stage 1 and cannot include an absence that has already been given a stage 1.
It may be brought into question if you unfortunately had a consideration for dismissal review where interviewing manager can look over all relevant absences.
I suggest that you contact your union rep ( if a member) and set up an informal attendance review meeting accompanied by your union rep in relation to the short term absence of 3 days and enquire why both absences are being added together. :arrrghhh

thanks for your help

I am a new deputy rep, dealing with a members AV1 and have argued with the manager over this, just wanted to check if i was right to do so.
I have warned the manager in question that if he issues this stage the member will be putting in a grievance.
Hopefully the manager will see sense

I've had this debate a couple of times. I have to say, that while it's clear you're only on a stage for 6 months, I've not read anything anywhere to say they can't do you twice for the same absence. The attached Attendance Agreement says your attendance record is based on everything in the last 12 months. It says nothing about absences only been counted once.

Absolutely happy for anyone to prove me and the gaffers DEFINITIVELY wrong.

As usual it depends on the wording in the attendance agreement and how it is interpreted in relation to formal attendance review by the manager overseeing the review meeting.
In the processing and actions of the Attendance Review Guide 1 & 2 ( Page 21) ALL ABSENCES UP TO THE DAY OF THE MEETING WILL BE INCLUDED IN THE ATTENDANCE REVIEW.

ALL ABSENCES UP TO THE DAY OF THE MEETING WILL BE INCLUDED IN THE ATTENDANCE DISCUSSION FOR THAT REVIEW
SIMULTANEOUSLEY THE AGREEMENT ALSO STATES THAT BY IMPROVING ON THE STANDARDS SET BY RM IN THE NEXT FIXED 6 MONTH PERIOD HAVING PREVIOUSLY BEEN ON A FORMAL REVEIW 1 NOTIFICATTION THEN YOU WILL BE REMOVED FROM THE PROCEDURE.
Therefore having been removed from the procedure how can all absences up to the day of the meeting be included in the attendance review this in my opinion is where the contradiction arises. :shock: :shock:
