Where do I stand?

Post by Loopylau89 »

Right... Long story short.

October 18th off sick with bad back (lower back sacriliac joint)

21st nove OH referal (4 week delay from DOM refering)

27th dec Phyios referal (further 4 week delay from DOM for not reading the OH report)

RTW 9th on rehab plan

Physio reccommended drop in hours and gradual increase, DOM reluctantly agreed after pestering from union rep.

Physio reccommends ill be able to be on full delivery around the start of April.

Dom very unhappy about this and is now threatening IHR (im only 26), if im not back on full delivery by the end of the month. there has been significant improvment with my back, but not enough for full delivery, i have occasional relapses with severe back pain.

The problem being is they are meant to increase by delivery load by 30 mins per week, how ever instead of putting me on half a round etc im sent out here there and everywhere with lapsing thats been left behind and sent out in amvan, so im not really doing half a round properly.
My union rep had now said that he needs to push me to try and get back on full delivery by the end of the month as DOM is pressuring.

Note needs to be made that our DOM is on a mega war path to get rid of people through sickness/health, already tried it with two others in the office and one still awaiting the result. So the union rep feels it will be hard to fight this as well.

Im now stressing and getting worried that if i dont get out on full delivery that im going to lose my job. I really dont want this to happen as i have a 3 year old to look after and a house and bills to pay for. Theres not many other jobs around at the moment especially not that pay so well.

Im currently 30 hours p/w and going full time in another job would not benefit due to extra childcare costs.

Really would appreciate some advice on this as no longer know what to do :(

If your local rep isn't much help, get in touch with your area rep they should be more helpful

Your DOM referred you to OH Assist as RM appointed occupational health consultants for their assistance in creating a rehabilitation work plan in relation to your medical condition that is designed to assist in a full recovery and a return to your normal duty.
DOM would have received a copy of the rehabilitation work plan and you would have also been copied in.
During the term of the work plan DOM should have been holding with you a weekly rehabilitation meeting monitoring your progress in relation to your capability in performing the work allocated and the pain level that you are experiencing on a scale of 1 to 10 if adjustments have to be made.
The recommendation in the work plan for your return to work on the 9th was reduced working hours to be increased by 30 minutes on a weekly basis which would have been monitored at the weekly rehabilitation meetings but your DOM has breached the guidelines of the OH Assist report and should have made this clear to DOM that work expected from you has exceeded their report with you now completing more than half a round probably due to occupational requirements which is not your problem.
Workload exceeding your rehabilitation plan is as you have stated is still giving severe back pain and now the threat of returning to full duty before the physio recommended date.
I would suggest that you contact your DOM for a re-referral to OH Assist and explain your present circumstances that your DOM is ignoring their original recommendations which in effect is exaggerating your recovery rate.
You could also back this up with a 2nd stage individual grievance on the conditions which you are enduring and this grievance will come to the attention of the next level authority over DOM'S head for him/her to address this matter.
You may also feel like contacting your area union rep on this matter.
