Withholding overtime?

Hi there new to the forum but just a few questions


1) are there any policies that a manager can follow that involves the practice of counting up my hours and the payment of overtime?
2) any documents that I can provide to my manager that would point out 1) pay the overtime the day it is worked 2) don't withold overtime 3) don't force people to work overtime then refuse to pay it until 39 hours in reached or something.

As it has been happening a little while now and I'm getting annoyed and I am not going to be working overtime from now on,

Example last week
Week 1) I went over Thursday, Friday and Saturday by an hour but because on Tuesday I was an hour early (I did the job correctly and it was just a very light (surprisingly) day, when I returned I did my d2d items for the rest of the week which brought me to I think 10 minutes before my duty end time. So I only got paid 2 hours out of the 3 hours that I worked.

Yesterday I was over by an hour and I said as long as I get paid my hours I'll go over - so okay we agreed an hour fine. :thumbup
This morning I went and told them that because of commitments outside of work (picking up my daughter) I would need to be finished on my time and that Wednesday (2.30) Thursday (2.45) Friday (3.00) I would not be available to work any overtime at all. Okay that is fine let us know on the day. (Why say this? I've just informed you, but okay I'll inform you each day)
Today I went over by two hours (not all Tuesday are light) and didn't have time to prep my d2d for tomorrow so I'll try and squeeze the folding before going out on the duty.
When I got back I told the other manager who was still there I wanted my two hours put down and was told no, until you work 39 hours you don't get any overtime, I said no that can't be right I worked TWO HOURS TODAY OVER MY TIME AND ONE HOUR YESTERDAY I DESERVE TO BE PAID THE OVERTIME, but no - simply told that it is up to me to make sure that I work 39 hours then any hours over that they'll pay so at the end of the week it is up to me to check if I have done over 39 hours (not them, they don't have time to check our times?? they said) :arrrghhh

So tomorrow I will be informing them I cannot work any overtime any longer and that any time I am back early that it is up to them to give me more work (I do not mind working to my time I will work the hours I am paid for, - IF THEY PAID ME OVERTIME PROPERLY THEN I WOULD WORK IT!) :crazy:


So any documents available that state that managers can keep/collect my hours and do as they please? In previous jobs if Monday I worked 2 hours past my time I was paid 2 hours extra) not sure why Royal Mail (maybe just my manager) think it is different unless it actually is but after digging out my contract and reading it I can't see any sign of it.


Any help at all would be appreciated! Sorry if this is jumbled up or makes no sense I'm quite annoyed and can't think straight either. :cry

Inform your manager you will be taking the accumulated time owing off the delivery of the round on the last day of the week i.e. Saturday? :whistle

Im a little confused, on one hand theyre saying they dont know how many hours you have worked and its not their job to know, but at the same time are denying you overtime as you havent worked enough hours :crazy:
Are you not a member of the union ? your rep will be able to help you with this.

If hes saying this then it implies that once you hit 39 hours you can just stop working if you choose to (as anything more than this is overtime) For instance the hours you worked overtime (but not classed as paid overtime by him) earlier in the week are banked and means you may only have 3-4 hours left on Saturday till you hit 39 hours for the week. Now theres no way in hell hes going to agree to that come Saturday when you tell him youre going to go home early, so I dont know what the manager is going on about, seems hes just trying to pull a fast one, again talk to your rep.

I was on another duty today and the person who was on yesterday 1) failed to prep or deliver any d2d (but management are dealing with it?) Finish time was 13:00 and I got back 14:50 and unloaded and left after discussing.

Our union rep is now left 100% he wasn't very good no offence to any reps (our previous rep was excellent but had to leave due to some joint problems) our newest rep he was a yes man by all means, he just agreed to everything our manager said and then he left!!! :silenced I've sent an email to the address listed on the cwu website for our area. Thankfully it is my long weekend so I can just put everything out my head come Friday afternoon.

I'm looking for any documents, files anything I can produce to them to say - no you can't "BANK" hours basically as they both are under the influence you can, I have said several times I don't want this banking and I want paid for the overtime I do - and if I am ever back early then provide extra work to bring me to my time etc yada come Friday I will be going in and telling them I want paid for my three hours as I will not be "BANKING" any more hours this week.

Ive got a feeling there is no rule against it, but its not an accepted RM policy.
I think youre doing the best thing by now refusing to do any OT, just follow the cut off procedure and let the manager deal with it.

Thank you for the reply.

So would I be correct in saying that I notify them when I arrive I cannot preform overtime today, then I put in all my mail, packets etc and then tell them I'm ready for them to make a decision on what to do? Do I just let them make the decision to remove a couple of streets or parcels and roll with it, then come my finishing time bring back if anything I've got too and let them deal with it?

you dont have to tell them when you arrive, but at the earliest time you think you wont be able to complete that day. At that stage its up to the manager, they could ask you to take it all and see how you get on, or tell you to leave a certain part. Whatever it is, make sure you return to the office at the correct time so you can leave on time. The most important part is informing the manager before you leave.

Yes , our busiest day what with all the parcels , still got every house to pass and d2d's so because our finish time is earlier, we go over. Ours do that , knock off minutes from o/t and don't pay any at all if you miss even 1 signing in/out ! *robbers smilie * :Very Happy

there is no agreement on BANKING OF HOURS he is just trying it on
