Any time limits for disciplinary hearing to decision?

Post by griswald »

Just wondered if there are any CWU agreed or legal requirements for time limits for disciplinary decisions to be made.

Scenario is that a disciplinary for Gross Misconduct was held on 9th Jan, copies of notes received and returned on 16th Jan - still waiting for a decision!

Thought it might have been 21 days or similar, but all I can find is the phrase 'as soon as possible"

As soon as possible covers a vague time period. If you check the conduct code it clearly states, all issues should be dealt with swiftly and fairly. Usually the decision making manager would write to you after 3 days either wit a decision or a reason for any delay in making his/her decision. Normally the would state the reason for delay is further investigations, annual leave or sick leave.

If the decision goes against you and you then appeal this delay will be noted especially if it goes to tribunal

Good luck
