HELP needed with attendance procedure.

Post by dan80 »

I was on sick leave for 3weeks, I have been back in work for 8 days now and have had no welcome back meeting. On Saturday morning my manager told me in front of about 5 other staff that he would be giving me my stage 1 on Monday. I have had no invite to this review meeting. And no welcome back meeting, also telling me in front of other staff is surely not right. Where do I stand with this? Can I be issued with a stage 1? Or as correct procedure has not been followed can it not be issued. Any help please.

Having been off for a period of 3 weeks you will in RM eyes classed as long term sick and you have not mentioned in your posting if within that 3 weeks there was a referral to OHS. The welcome back meeting should have been completed in your first day of return to ascertain if you are fit to carry out your duty or does modification be required. This would clarify as previously stated.
It is not mandatory for a 1st stage warning to be issued and is dependant on the merits and the circumstances of the absence. For your manager to inform you that a 1st stage warning is to be issued without hearing the circumstances for your absence is prejudicial and just as important to inform you of this in the presence of work colleagues has breached confidentiality and if this can be substantiated a grievance should be implemented to this effect.
Although the welcome back meeting has not been conducted it does not hide the fact that you were absent for 3 weeks and have breached the national agreed standards of attendance.
What needs to be argued is and as you have not mentioned OH Assist attendance has your manager fulfilled all the obligations in the welcome back meeting that never took place.

Forgot to mention in my posting if it does not go in your favour and a first stage 1 formal prompt is issued make sure that the absence is recorded from the date of your return to work and NOT the date of the stage 1 meeting as they are in fact stealing weeks from your absence record if a further absence occurs.
