Clawback of Bank Holiday Credit

Have been notified today that my bank holiday credits for Christmas Day and Boxing Day have been withdrawn because I was absent sick over the Christmas Period. I do not think this can be correct. Can anyone who has knowledge of how this operates please advise me if this is the case or is it the DOM trying to reduce costs and increase his bonus.

Christmas Day is not a bank holiday, just an ordinary day. You are due your Boxing day credit.. Ask for the cash then they will give you a day off instead.

Err Christmas day is a bank holiday he is due that back too. Get your rep onto it

Christmas Day was a bank holiday and I had been given credit for it. However because of being off sick they have now clawed back the two days, so if they are not going to be giving it me in credit, they certainly won,t be paying it in cash. What I am asking is whether there is an agreement that allows them to do this.

Sounds like you are being conned, if you work at least a 4-day week.

Only work 3 day week but still entitled up to 5 of the 8 bank holidays if they fall on a day off. I have been allocated 5 as this number fall on my day off for the current holiday year. However today receive a new Annual Leave Card with the Christmas Day and Boxing Day Public Holiday Credits scrubbed off and a note at the bottom from the DO saying 'Have been informed not to credit days back when someone is on sick leave or other absence'

I would only be entitled to have them credited back if they did not fall on a working day. ie. if my full entitlement for the year is five of the eight, but 3 of them fall on working days then I would only be entitled to a credit of 2.
The question that I don,t seem to be getting an answer too is are they entitled to claw back any of my entitlement if I am sick on those days, as I was on Christmas day and Boxing Day.

The answer is no RM policy is that BH credits are not given back if you are on sick leave

Thanks everyone, had that confirmed by Area Rep. I cannot for the life of me, understand why you can reclaim holidays if you happen to be sick during that holiday, yet you cannot claim a public holiday credit when off sick, even though you would have not been on duty had you been well. Perhaps someone could explain that one to my ageing brain.

Is Christmas day included in the normal bank holiday entitlement, or is it classed as a "Non working Day"??

I was under the impression that there were two days where you cannot be contractually forced to work (Unless essential services) That was Christmas Day and Easter Sunday

It's included in normal bank holiday entitlement

You can only claim xmas day as a bank holiday credit if you work on that day and it is your rest day.

If you have booked holiday some offices will show as only taking 4 days or some will show 5 days holiday with 1 day BH credit.

If you are sick you are not at work and thus getting sick pay. You have not worked on xmas day so no BH credit.

Still does not answer why you can be on holiday receiving holiday pay, but then go sick at the same time and get the holiday credited back to you. What is the difference between being sick on an annual holiday compared to being sick on a bank holiday?
