Not advising anyone to do it my way but consider the following

Our unit asks all staff every December to sign an opt out of working time directive..

As I've been following the whole back pay/holiday pay thing
Every January I rescind my opt out as is my legal right.

Now I'm not saying RM would use the fact that some of us signed to opt out

But u never know

The opt out is specifically in regard to the maximum number of hours in a working week it has nothing to do with holiday pay and also as you have a contract for 39 hours it is actually pretty pointless to reindeer the opt out as you can refuse to work over your contracted hours regardless

I'm not 39 hours.
And it's rescind....nothing to do with Rudolph.

Even the opt out itself is pointless though as most of the directive only applies over a 17 week average.

All that aside its used at our do by management to apply pressure to do overtime.

They can put the same pressure regardless of an opt out signed or not

Even if a pt contract less than 39 the point still applies they can only ask you to work over your contracted hours just the same as they can only ask you to work over the 48 hour week
