hi a workmate of mine would like to know if he is entitled to special leave as his wife is going into hospital for a kidney transplant. she has the op on tues 20th jan which is my mates day off. he also has sat 24th off (he only works a four day week as cover) and is off the following week but doesnt have enough hols left for the 3 days the previous week. any info would be appreciated tia

He might have to take the 3 days with no pay if the dom doesn't give it to him as paid special leave.

Yes, most likely. If that wasn't the case maybe DOM could allow him to work 3 of his 4 days off the following week so no loss of pay? Then again I assume he would need those days off to look after his wife if she was back home as she will be sore for a couple of weeks so maybe he's discounted this suggestion already.

Don't forget we have new laws on flexible working now. It may be worth sitting down with your DOM and putting in a plan,I am sure your wife will need on going care for a few weeks. I personally would get area union rep to help put a reasonable suggestion together.

apply for special leave using the spaecial leave form (ask your lino) a decision will be made as to with or without pay

Depending on the woman's medical condition she may b e covered under the Equality Act.
As her carer, if that is his role, then he too would have some protection.
