Got a question for a CWU Rep? And all CWU related matters.

Hi, my manager called me in for a meeting regarding my hours.I am currently doing half my shift hours on the advice of Atos and hospital specialist.I asked for a Union rep to be present but he denied this request, he said I did not need one. During the interview I again asked for a rep to be present and he again refused.Can he do this? Am I only entitled to a rep for certain meetings? Thanks for your help.

You are entitled to representation by a CWU rep or a friend at any meeting you have with your manager.
I would contact your rep and ask him to get the manager to re arrange a meeting to discuss your issue with the rep in attendance. :thumbup

never have a meeting with a manager without a rep in attendance as they will always try to twist things in their favour.

It's not up to him whether you need a Rep. But he would say that wouldn't he.

I recorded the conversation on my phone and my rep is now telling me I could be in a lot of trouble for doing that.I can't win!

You are always entitled to have a witness, whether it is a friend or your CWU rep. Your manager had no right saying you can't.
Get your rep to rearrange the meeting and if the DOM refuses, put a grievance in.

As for the recording, you should have informed your DOM that you were recording the meeting for future reference, failure to inform him can make it a illegal recording.

It seems to me that this meeting was a rehabilitation meeting to regulate your progress in relation to the recommendations and programme that OH Assist put forward to your manager and which you would have been copied into.
In this case representation what not have been necessary unless your manager has decided not to abide by the rehabilitation programme that was agreed with OH Assist and hospital specialist.
If my assumption is correct then you need to ask this manger for a re-referral to OH Assist explaining your situation and the intended actions of this manager who is not accepting the advice of OH Assist who is their appointed Occupational Health Provider.
If manager refuses your request then this is the time to bring your local or area CWU rep into the discussions.
In relation to the recording of the meetings this has already been taken to an Employment Tribunal and was appealed and the EAT ( Employment Appeals Tribunal ) decision was that it is acceptable for employees to record at disciplinary hearings.

Thank you for your replys, yes, my manager was not abiding by what Atos had recommended, that is why I asked for union representation.All my manager seems to be concentrating on now is the fact that I recorded the conversation.He is not a happy chappy!!

You can get yourself in a serious amount of trouble if you recorded the meeting without telling the manager. Although it is not a disciplinary offence as such, this will be a serious breakdown of trust and respect between the employee and employer.

If i were you i would apologise to your manager and say it was a grave mistake and error of judgement on your part and that you acted out of ignorance. He might even respect your more then for your honesty

If he had not refused me representation then I would not have had to record him.There is no chance of me apologising. It's him who should be apolgising to me.
