Part time cut off not the same as full time?
I'm a part timer and I'm contracted 25hrs, 9am-2pm. For the past couple years I have been however working pretty much the same time as full timers. My question is, as I work full time hours would my cut off times be the same as a full timer? My union rep seems to think not, as overtime does not count, and also we do not get the same break times. So my cut off times and break times should be what you would get if I worked 9am-2pm. Surely this is not right?

I don't understand what you are asking.
If you are contracted to work until 2pm then that is the time you finish.
On a 5 hour day your meal relief entitlement is 30 minutes/day (and not 40 like f/t)
That break shouldn't be scheduled at the end of your duty.
So your cut off time is 2pm - minus however long it takes you to get back to the DO and complete the end of duty tasks.

If he's cutting off then he's not working full time hours - unless he is doing approx. 3 hours overtime between 6 and 9?raikky wrote:if hes working full time hrs then hes entitled to 40 min break
It isn't clear.

Re: Part time cut off not the same as full time?
I am contracted 9-2. But for the past couple of years I've been working 6-2, like a full timer. So I get roughly 3hrs overtime everyday.
At our office full timers are told to have a 20min break before and they can finish 20mins early for their last break.
On Saturdays I don't know why but full time staff are allowed to have their full 40mins at the end. So essentially they finish at 1:20pm on Sat.
I asked if this was the case for me being as I work the same hours. Union rep said no, as overtime does not count and my finish time is 2pm not 1:20pm. Whats funny he said I was only allowed a 10 min break on my 25hr contract.
Hope that helps a bit more sorry.

Re: Part time cut off not the same as full time?
Firstly a 5 hour day attracts a 30 minute break and as stated earlier in the thread, if you are working an 8 hour day you are entitled to 40 minutes.
The meal relief is based on hours actually worked and not contracted hours.
While the office custom may be to take the full 40 minute break at the end of the duty on Saturday, this is certainly not best practice.
But if that is what the office is allowed to do, then that has to apply to you as well.
Even if you split it 20/20 your finish time is 1.40.

Thought so, thank you. Our union rep is useless and couldn't care less for any part timers. I'll tell him Monday about this.

I think the OP is being shafted somewhat. If you do full time hours, whether contracted or some on OT, you get the same FT breaks etc.
Or else someone working a day off on OT isn't entitled to a break?!

If your working a shift even on sa rate you are still entitled to breaks depending on how long the shift is, regardless of whether it's a saturday or not the fact it's being paid at sa doesn't take a at your right to a break

You are entitled to a break but not a paid break under the SA agreement.zx135 wrote:clashcityrocker wrote:They wouldn't be if they were being paid Scheduled Attendance ,,,,,,,, unless it was a Sunday.lala wrote:

I read that as you can have breaks - but they aren't paid, except on Sundays.

Yes I know it's not paid but they do get a break, you just said they wouldn't get a break (paid or otherwise)

Someone working SA may or may not be entitled to take a break - it would depend on the circumstances.zx135 wrote: Yes I know it's not paid but they do get a break, you just said they wouldn't get a break (paid or otherwise)
If you were doing a collection on SA you couldn't decide you wanted a 20 minute break and fail the collection times. (Well you could but there would be consequences)
Someone working their day off on SA could take an unpaid break as long as it didn't interfere with the smooth running of the operation.
But the agreement as Teebs has posted it says They (SA) do not attract paid meal relief's or breaks.
So you don't have a right to a break.
But this is all off topic and has nothing to do with the original question.

If you have been performing this overtime over a number of years, then speak with your Rep and request that he reads over the Agenda for Growth document where it says if employee has been performing overtime for 12 weeks or more then it can be extended to your contractual hours, just idea
