Advice for a colleague

After a bit of advice for a fellow worker who I bumped into today.

He had an AOD at the end of May, which resulted in him tearing ACL & medial meniscus, he has seen a specialist through OH to get a diagnosis which stated he needs an athroscopy, he has only just been seen by NHS consultant who has stated that he won't consider putting him on the waiting list for surgery until Feb next year, so realistically with the NHS waiting times and rehab it could be another 12+ months until he will be able to resume his duty, is it right that his pay will be halved at the 6 month point despite it being an AOD?

you can carry on working with a full acl tear and cartlidge damage so he wouldn't need to be off work. he just needs to balance it by being a bit more careful whilst working

Well apparently not according to his GP and OH assists orth surgeon

Edited to add, he says his ACL is a partial tear rather than a full

His reply did make me wonder as well, especially when I saw the bloke hobbling around with a crutch.

Anyway medical opinion states he can't work at the moment, OH assist & RM agree, so anyone have any ideas about his pay with it being an (agreed) AOD, the hazard wasn't noted in the duty book at the time (now amended)

ACL = Anterior Cruciate Ligament

If you tear that you'll need an operation! Try walking, or putting a load on your leg, with that injury and you'll know it!

Does the injury preclude him from doing anything? What about indoor work.

DOM told him there is no indoor work, and nearest MC is too far away to be practical

How can a DOM say there is no indoor work for him to do, when we are approaching Xmas pressure and workloads for duties will be even more silly than usual?

No suitable chair bloke can use to do some IPS sorting?
No suitable chair for bloke to to use to allow him to throw D2Ds in frames, or even standard mail, while duty holders are on indoor meal relief?

Sorry should have made it clearer, he wants to go back to work in any way possible, but Drs, OH & RM have stated that he isn't fit for duty and despite him asking several times, his DOM has said there has no "suitable" indoor work rather than there being no indoor work full stop, guess thats RM covering their arses incase he does something at work which aggravates his injury and going against medical advice. (I know theres a first time for everything :funneh )

So to the original question is it right that he should be financially penalised despite it being an AOD? He has spoken to our unit rep, but he just shrugged his shoulders and told him he'd look into it, would he be better speaking to an area rep or even area H&S rep?

TBH I don't know if there is any leeway in the sickness agreement or any discretion by managers allowed. There is a slight sticking point in that the injury wasn't reported immediately but there could have been a reason for that.

The 6 month abatement of wages shouldn't happen if it was an AOD.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

It was reported immediately as a manager had to come out and take him to A&E, and he came in and did the ERICA the next morning
