The proceedings just ruled on were a test case for, I think, an engineering firm. It should when finally appealed, counter appealed and settled be too late for anyone older than 40 as we'll all be dead by then.
You can bet your lives though, that Holidaypay4U will be ringing us all up then to try and get a slice of the action.

I know at least three 27-hrs contract blokes in my smallish office that have been averaging close to 45 hours for the last 1.5 years or so... And a few others that were on 30 hours before revision that worked full-time hours for years.
They should be entitled to be paid the 'maximum' basic of 39 hours for the 22.5 days or so holidays.
Employers and CBI will fight these tooth and nail because it is at the care of their low-pay low-hours economy.
Even if passed, I doubt it will be retrospective - some companies will simply be unable to pay.

Before everyone gets too excited this desision will be appealed to death so the final ruling almost certainly from Europe won't be made for a good few years.cp wrote:does this new ruling about holiday pay apply to postpersons

I also read it was for people who do compulsory overtime so as our overtime is voluntary (B&H aside) we might not qualify. I think there is already a S.A payment to compensate people for holidays?

the news is as clear as mud
does this mean regardless of appeals we must now be paid an average of actual hours worked with immediate affect? (think i read average is 13 weeks prior to holiday)
also says on a news site "Unions are already asking workers who haven't received the same pay during their holidays as the rest of the year to contact them."
no doubt the cwu will contact us in a year or 2, the only mention on their site is a tweet link to the unite site!
cant really see any difference on how they decide on if the overtime is voluntary as surely any overtime is just that!
my manager asks me if i can work day off and i do or don't depending, therefore its planned overtime

Was on 26hr contract then 32 hr contract for 11 years and was averaging easily 40 odd hours a week hope this can be back dated I for one would pursue this...

Only applies for last 3 months I heard. However we are being paid SA for last summer hols and any holiday SA after that
