Accused of wilful delay

Post by vanman90 »

So my duty structure is

19.35 19.40 unload vichele and hand back keys
19.40 19.50 drive back to depot were I got the van from.
My manager has suspended me from outdoor dutys pending investagation because I cut off at 19.35 he says my finish time is 19.50 dispite having to travel back to depot and unable to stay over time.

How can you drive back if you have already handed over the keys?

What time did you leave the depot at end of shift? And is that exactly same time that's in your duty 318?

Actual from your previous posts about not being paid ot in other office

Is it the second office where you are working the ot that is charging you with wilful delay or your home office? Also is it the case that the second office expect you to work till 1950 but you are travelling back to your home office to finish there at 1950?

If the above is correct, signed off by the manager as part of the SA/Collection - Then this is all that needs to be said.

Failing that you remain at the office until 19.50, deliver the van back but agree they add it as 15 minutes overtime everyday.

I maybe as thick as a whale omelette ,but what have you wilfully delayed? I can't see you doing deliveries at 19:35hrs somehow, literally and figuratively.

If that's the case and you were using a pda to scan boxes insist on a print out of the times boxes were scanned then sit back and enjoy your paid vacation that doesn't affect your annual leave you don't have a case to answer. Unless you have signed something to say you would work over or you didn't inform your office you couldn't complete the duty in time then you have nothing to worry about
