Hi thanks for reply.
This has been disclosed and now has escalated to gross misconduct bringing company into disrepute but yet it was not in media.

Get your union rep on it don't want to prejudice your meeting with the bosses but if theft is involved that would be enough for dismissal anything else you can get your rep to argue your case as things like these happen.

Doesn't need to be in the media - just means that by being known as an employee of a company whatever happen reflects badly on the company as a result

Also depends whether this type of offence is covered in your contract

without knowing the offence ( and no I do not want you to put it on here) hard to say really

Anything involving dishonesty, violence, sexual crimes are likely to be grounds for dismissal generally anything of a criminal nature.

Minor motoring offences would be below the threshold for dismissal.

Thanks so much for your replies. This criminal conviction only received a fine and some community service. I know of other cases in the mail centre that have more serious convictions that royal mail know about and they where never charged with anything by royal mail. These people received custodial sentences also 2 years suspended sentence and is an acting manager surely there has to be a level playing field?

It all depends on the actual offence each case is different also just to point out, community service is direct alternative to a custodial sentence so in effect getting community service is as serious as a custodial sentence

Ok i know your saying community service is serious, but it is also classed as non custodial. The problem i have is other members of staff have more serious convictions and where given custodial sentences and spread over front page of daily newspaper and they where never charged with anything by royal mail they still have their jobs.

Royal Mail's code of conduct deals with criminal conduct committed outside the workplace. It says that criminal actions should not be treated as an automatic reason for disciplinary action or dismissal unless the offence is relevant to the convicted employee's duties. The code makes clear that the key considerations are whether or not the conviction makes him or her an unsuitable colleague in the eyes of other employees or brings the business into disrepute. The code also requires employees to inform their manager if they are charged with, or summonsed to appear in court in relation to, a criminal offence (with the exception of minor road traffic violations).

If you are charged with any criminal offence whilst employed or engaged by Royal Mail Group, you must immediately inform your supervisor of the details. Where a person
engaged in Royal Mail business is involved in a criminal offence, the police have discretion to notify Royal Mail of convictions and may provide other relevant information.

This list is actually designed for new entrants but gives you a rough idea of what they consider unacceptable.

Please note: The list below is not exhaustive but instead is designed to give an indication of the type of offences that Royal Mail normally considers unacceptable.

Theft and all offences of dishonest appropriation (including going equipped to burgle, taking a vehicle without consent, handling stolen property, making-off without paying)
Fraud, forgery or counterfeiting offences (including benefit deception, traveling on public transport without paying)
Firearms and weapons offences (including possessing a sharp object in public, possession of a noxious gas)
Terrorism (other than certain conflict-related offences subject to the Northern Ireland Good Friday Agreement - these do not need to be declared during application and will be considered by applying the employers’ guidance issued by the Office of the First Minister & Deputy First Minister, Northern Ireland)
Offences under the Postal Services Act 2000 and prior legislation
Arson
Supply or intent to supply any category of drugs or possession of category A drugs
Offences against the Justice System (including perjury, bribery, making false statements, contempt of court)
Offences against the person (including assault, causing grievous or actual bodily harm, battery, affray, racial or verbal harassment, making threats)
Sexual offences
Breaches of orders

I wouldn't be too concerned about "other members of staff" and concentrate more on your predicament. You should inform your manager because as sure as eggs are eggs somebody else will and that puts you on the back foot if you're called in to explain the circumstances. How serious the conviction is will be determined by RM Management and offences by others won't be used as a yardstick but what the current rules are and may even be coloured by how good an employee you are.

Hi. Yes this incident happened over a year ago and i told my manager right away as j was accused of this crime but i am innocent. Unfortunatley for me courts found me guilty with no hard evidence. I was allowed to work my duties up untill i was found guilty and sentenced. I was then suspended for being threat to staff then guilty of bringing company into disrepute. Its been now 3 fact findings and near 4 months ago and passed so many times still no decision. The stress of loosing my job is really affecting me i juat want back to work.

:hmmmm It seems an unconscionable amount of time for a suspension when the facts and the result of the case are known. If you are a member of the union then contact your rep if you're not then try to speak to a solicitor who deals with employment issues. TBH it looks like they are trying to wait you out in the hope you'll resign even if you are being paid.

Yes its been too long for anybody to wait on a decision. The union rep is onto it and feels it is disgraceful the way i am being treated in all this. This has been passed to 4 different managers to make a decision which is beyond me why its been passed so many times. In the meeting of addressing how company was brought into disrepute the manager was asked and he just smiled. He then said he was not addressing this and was taking another fact finding.
