It depends on the circumstances.
The Way Forward agreement allows 5 days to be carried over but I doubt if anywhere upholds or polices this.
If sick leave has prevented someone from taking their annual leave then they can carry it over. The total amount is unspecified.

Perhaps someone really needs to have a look at this.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

Our area is now enforcing the 5 days that can be carried over as per the way forward agreement and privatisation is being given as the reason.
Unused holiday entitlement due to sick absence would probably allow an increase of 5 days.
Applying for an extension to the 5 days by written request to your lino as per way forward agreement has yet to be tested.

i have 12 days owing. i have put 6 requests in for days off and have been turned down every time. been told i have no chance of any time off till next year so i think that the amount of days you can carry over doesnt hold water.

Send a note in to say that you expect any holiday entitlement in excess of five days to be paid as overtime, down to the fact that the DOM refuses to allocate you the days off that you have not been able to use down to his operational needs.

this is against the law,if you earned them you can take them that year
if you took it further you would get them unless you barter with them for july or august 2015 off!

A lot of our leave is a statutory entitlement which they cannot refuse - if you work 5 over 6 days you are entitled to 28 days statutory leave. Some of which can be the 8 days public Holidays.

Therefore if they owe you 12 days - and you are entitled by contract to 6 weeks (30 days) then some of that is statutory and they are breaking the law by refusing to allow you to use it in the current year . If you don't buy extra and only get the basic entitlement then the majority of the untaken leave is statutory.

One thing that hasn't been tested yet as far as I know is the case of untaken purchased leave being refused, My feeling is that you would be entitled to a refund for those days, if they can't honour them in the current year - or they should automatically be carried over on application.
