holidays pick 2015 and DSM overrule seniority

Post by gillesq »

Hi! Can the DSM over rules the seniority to allow a "younger" worker to pick holidays before the " older" worker?

Its a Yes and No answer.

Yes he can overrule the seniority rule for holiday selection because you are NOT allowed to use seniority for leave section.

As long as the selection process is fair and above board and IIRC the CWU is in agreement with the method used.

Note
also that seniority will not be used for leave selection (except possibly to allocate employees
into rotating groups) once local leave selection processes have been reviewed. This will be
necessary to conform with the criteria set out in the agreement on Annual Leave: “all
employees will be included on an equal basis”.

If BOTH have been given a fair opportunity to select leave then its ILLEGAL to use seniority to the benefit of the senior or junior man.

A first site as its the 2nd stage pick then the senior man has been given a fair opportunity to select his leave and therefore he cannot use his seniority to bump a junior man from his selection.

Hi, I was wondering whether any other office has been told about the new holiday pick for 2015. We have been told we are going to be split into 3 groups. The first group will get the first pick, 2nd group 2nd pick and 3rd group 3rd pick. In each group names will be picked at random for each group. This will then rotate every year.

I am slightly concerned about this as I am aware that our manager in the past has when 2 people have gone for the same date, supposedly put the 2 names into a draw to find out who will get the date but has not actually done this and has just given it to who they wanted to.

For us it'll be several weeks into 2015 before there's any mention of a holidays pick for next year.
