IM OFF
Returned to work on Monday morning after just over 3 months sick, did 2.5 hours delivery prep then dragged in to office and suspended with the alleged abuse of sick pay charge. Some numpty at d/o thinks they have seen me working. How do they justify that when signed of work and unable to drive (knob heads). Any way this is just plain victimisation and is now causing me stress and anxiety, so they will now lose a full time member of staff, who knows 17 out of 25is routes. I realy dont need this hassel in my life. Well they can stick their job where the mice cant reach it.

Re: IM OFF
Think they have seen you? Photo or video evidence that can be positively identified as you?
Sounds like you could take em to the cleaners at employment tribunal for constructive dismissal.

Re: IM OFF
Sorry trolley mate, but they don't need "Evidence". All they need is a reasonable suspicion to suspend. Then if they do dismiss they only have to prove that it was a reasonable action in the circumstances as they were known to the dismissing manager at the time.

Re: IM OFF
Rubbish!! They need "proof" that you have been working elsewhere when you were on sick pay kevo!!
By the way suspension simply means that they will investigate those claims; it does not necessarily mean dismissal. For them to dismiss you they need concrete evidence that you have worked for someone else, if its another employer, they will contact them
If they dismiss you and you haven't worked elsewhere; you then take them to an employment tribunal.

Re: IM OFF
But if it that easy TBT, why haven't RM been P45ing every OPG not complying with lino/DOM wishes (regardless of whether the instructions comply with official protocol) on the first instance of them going sick?TrueBlueTerrier wrote:Sorry trolley mate, but they don't need "Evidence". If they're paying you, and you haven't done what they're accusing, I wouldn't worry about it. Dig a boxset out and get your feet up. Demand an apology when you get back.

Re: IM OFF
How did this managers' office "meeting" end? Did you verbally quit, or did you leave the depot having been told they will be in touch?

Re: IM OFF
In cases like this, you need a trade union rep in with you mate.
If they cannot provide you with one, then you do not go in!!!!!!! They cannot force you, and they will have told you right at the beginning.
The manager has already brought his sidekick to listen over the conversation and back him up. Who's backing you???
Oh well, you will just have to sit tight and wait now.

Re: IM OFF
No I wasn't told what was happening, because one of the screws is a trainee manager I thought it was a back to work interview, no mention of allegation or offer of union. Hope screw who suspended me drops dead. I hate the man.

Re: IM OFF
Sounds like an abuse of process to me. They can't just dismiss you on hearsay, they have to prove it , otherwise we would all be getting fired, this is getting ridiculous. Did you have regular meetings when you were off? Did you keep in contact, etc, etc. Don't do anything rash. Play them at their game. Anyway, why wait until you get back off delivery? Why not act when you returned to work, after your RTW interview? Very peculiar.
