I don't really want to shout about too much on here but I have today received notice that my complaint for bullying and harrasment by the dom has not been upheld. I went for an interview last week and apart from interviewing myself and the dom there was no investigation. I was told that witnesses would be interviewed and put 4/5 names to the interviewer but none of them were even contacted. Furthermore, I have also received the minutes of the meeting, and most of the issues ( main issue being my disability) we spoke about were just left out! This is dated the very same day the decision not to uphold the complaint was made so I never got the opportunity to question why the majority of the meeting was left out! I am fuming and will be appealing but any advice would be welcomed :mad

Did you go in this interview with a rep or colleague?
If they didn't question any of your named witnesses and have not provided a reason why not(it could just be that these witnesses have been knobbled or are too afraid to give evidence especially against a manager)then you should make it at big issue in your appeal that not all of the evidence has been gathered and looked at.

Make amendments to the interview minutes,put in where you told them something and it has been left out,if you have a witness get them to sign their initials against any amendments and get them to sign at the bottom that this is a true reflection of the interview minutes.

At the end of the day it's just managers looking after other managers,at your appeal ask the guy conducting it if he is an independent case manager,he will say yes I am independent then ask him who pays his wages. :left:

Audio devices have been used by OPGs in employment issues and deemed permissible at employment tribunal by the judge.

its all utter s**t , me and my p&l partner have put a b&h in over our dom we are still waiting 8 weeks for a interview and he is still doing what we put them in for , these cases should be done by an independent party nothing to do with the business , set of corrupt bastards.

Just keep banging them in one after the other, something has to give somewhere. Write to Moya, only yesterday she said she wanted to hear from us! Be rude to ignore such a polite request.

I would suggest that you ask all of your witnesses to make a written statement of what they know about your complaints. You should have been issued with an amendment form attached to your copy of the minutes that were taken when you were interviewed. You should have taken your own minutes or asked your union rep/colleague to make notes in order that you could compare them with those taken by the person taking notes for the company. You would then have been able to fill in the amendments form and sent it back prior to the Company Interviewer sending you a formal answer to your complaint. If this has not happened, you must make it known to the person who hears your appeal that you wish to place on record that you believe that the processes laid down by Royal Mail and the CWU have not been complied with, your witnesses have not been contacted/consulted with and you now also wish to place on record A COPY of their statements. Do not give them the original under any circumstances as they will probably not be seen again. Make it clear at the appeal that if the previous decision is upheld you will be progressing the matter in accordance with the laid down agreements which will include employment tribunal.

is there a particular format for the appeals letter? I don't want this to be another one shoved under the carpet due to a technicality ?

That is total Bollocks, please link the necessary Employment Tibunal. Such advice will result in an employee facing serious consequencies

If you are caught using any AV device in a meeting without prior agreement by all parties will result in a total breakdown of mutual respect and trust

Covert recording transcripts can be submitted to the Tribunal but it will be down to the District judge to decide if those transcripts can be submitted into evidence
