Keeping regional pay protection under the MTSF?

Hi. Got a tricky question involving the MTSF, regional pay protection and a resign.

About four years ago, I transferred to HWDC from Mount Pleasant, having my inner London pay weighting frozen under such time the national rate catches up.

I'm currently on a 15-hour, 36-minute duty. This is on a Saturday-Sunday earlies, so I get a Sunday allowance.

These Saturday and Sunday duties are gone in the new resign. However there are Saturday and Monday night duties available at the same 15 hours and 36 minutes.

My question is, if I pick up a duty that attracts a higher shift allowance than the one I'm currently getting, do I forfeit my regional pay protection, as I'd be getting more money each week (with the night allowance and partial Sunday allowance? I'm assuming you get Sundays for working between midnight and 0600?)

Sorry the bother. I read the relevant section in the MTSF2 - "regional pay protection" - it confusingly refers back and forth between "pay" and "level of pay." Also, no one in management or the local branch seems sure of the answer.

If you voluntarily transferred to HWDC from Mount Pleasant then I am surprised that your London weighing allowance was not lost instead of frozen but if you were left with no other alternative and as a surplus employee by business driven change had to accept alternative suitable employment which resulted in you receiving less allowances then the protection under the MTSF should have kicked in for your London weighing allowance.
If you are now about to receive a night shift duty which will attract a higher level of pay/allowances then you previously enjoyed before the transfer then there is no need to have your level of pay/allowances protected.
If the transfer was forced on you and I am not an expert on this but I would think you would be able to clawback the difference in the time spent in your duty at HWDC that was less than your London weighing allowance up to you commencing the night shift duty.

Sorry. Yeah. It was a forced transfer. Loads of us left (to Heathrow and other mail centres) when Nine Elms and East London closed.

I'm confused because I seem to remember it being explained to me by someone in HR that what mattered was that I didn't increase my hours and thus my basic pay.

It seems like a weird loophole. There are full-time staff on the early shift who want to go on lates. They should lose around £2 an hour if they start getting a late allowance?

What was your duty hours before the 15 hour 36 minute one.
If full time early shift staff WANT to go on lates and pick up a lesser allowance ( around £ 2 an hour ) it will be their decision and not a forced decision then they will not enjoy pay protection.

I came across at those hours.

The thing of it, if it does happen, full-timers going to late shift from early would lose £400 a year in holiday pay (they would lose £2 an hour going down to the regional pay scale.) This hasn't been remotely pointed out by management (or the possibility thought about.)

Anyway, for anyone in the same situation who stumbles across this years from now....

I kept my regional pay protection even though my shift allowances were increased.
