Flexibility

Post by kentpostie »

Could somebody kindly tell me if we finish half an earlier one day are we obliged to work extra the following day. Our office is suffering from summer lasping, where some of us deliver another round between us so they can save 8hrs pay. On light days this is ok but on heavy days its causing us to go over our time. My manager is telling me that due to an agreement a few years ago where we accepted £400 we agreed that we would do this. Thanks

You should only lapse if it can be done in your normal working hours otherwise it becomes overtime

If you finish work early one day (regardless of how early) and have fully completed your duty and you aren't asked to perform any other reasonable work then you are finished for the day. Any time gained by the postman does not get carried over to be used later in the week.

Your manager may request you to alter your attendance times in advance dependent on workload but it is not compulsory for you to agree. If you do agree to alter your attendance then the particulars of when that time is given back should also be agreed at the same time and should be given back the same working week.

But the title does not match the question. Even so the OP asks if he is "obliged" to work 30 minutes over 1 day after finishing 30 minutes earlier the previous. The answer is he is not.

Flexibility by 30 minutes over a week - voluntary

Banking - (which is enforced flexibility) is not agreed.

But in the real world, if you work the agreements to benefit yourself, don't be surprised when the bosses do the same. Easiest way to avoid them using this unagreed banking of hours (when it should be voluntary flexibility) is to work all paid hours.

The manager can request that you take part of another duty out or perform other reasonable tasks in addition to your normal duty where there is scope to do so.

If all the work can be completed within your contracted hours then you should do it. If however your workload is too much to complete on time then you are not under any obligation to complete it all, merely what you can manage within your hours. This is true regardless of whether you are being asked to do extra work or it is just your normal duty that will take you past your time.

If you can't complete your manager may ask you to either perform the work and book overtime or may ask you to work longer hours that particular day in exchange for shorter hours later in the week. You are not obliged to do so.

If a manager claims that because you finish early one day then you owe them hours they are either ignorant of the terms of the agreement or lying.

I believe the op is talking about 'reverse flexing' instead of working 30 mins over one day and getting it back that same week, his dom is saying that because he has made time the day before then he has to 'flex' over on a busier day to give the time back.

reverse flexing is not part of the agreement, and what the op described is banking of hours anyway,
