INCIDENT not Accident on duty !!!

OPG goes to work and gets injured driving a 4x4 land rover (on trial on rural) prolapse slip disc.
When he returned manager refused to fill in Erica report stating INCIDENT not ACCIDENT.
OPG sees Doctor off for month.
OPG comes back on town walk duties on REHAB arranged by manager not ATOS.
CWU rep knows nothing until he is asked by OPG to attend review 1.

What a complete mess !!!
ACCIDENT on duty normally discounted ??

Its illegal not to fill in Erica, manager could be dismissed for this & also arranged his own REHAB plan for OPG including delivery by pouch and not bothered about using LWT as mandatory new delivery methods.

The clue is in its name Electronic Reporting of Incidents and Accidents Erica. Either way it should have been reported and still can as it is the right of very employee to retrospectively report an accident or incident. There is no time limit and it is H&S law. Get your area safety rep on the case.

Sorry pop it in pete the clue is in its name to which you refer is wrong. ERICA stands for Electronic Reporting of Incidents for Collation and Analysis.

Irrespective of whether it is an 'Incident' or 'accident', it would initially just be recorded as an absence from work or sickness absence on the HR computer. If it triggers a Stage being issued the line manager would then have the interview with the person, and should then notify HR that the absence was due to an IOD or AOD, which do not count towards sickness absence or Stages being triggered, and the HR computer records should be amended to show this.
RM say this is so that the manager does have to follow up on how the person is, and is monitoring the situation.

In this case an accident in a Landrover does sound more like an accident than an 'incident' which as I understand it are things like robberies, assaults and dog attacks.

couple of points, it wouldnt just be recorded on the absence system it would also be recorded on ERICA

also being picky, an IOD or AOD, may not count towards to sickness absence or stages, its not a hard and fast will not unfortunately

and again it does not matter if accident or incident both reportable the same way

Makes things clearer.

In particular:-

1. The accident book or equivalent must be readily accessible.
2. It is a matter for the employee, not the employer or any one acting on behalf of the employer, whether an entry is made in the accident book or
equivalent.
3. There is no restriction on the nature and type of accident and injury that can be entered into an accident book or equivalent. It is for the employee
to determine whether or not they have sustained a personal injury and whether they have been involved in accident.
4. There is no restriction on the time within which an accident has to have occurred in order for an employee to make a record in the accident book
or equivalent. Regulation 25(3)(b) implicitly recognises that an entry may be made in an accident book at some point after the accident occurred.
