Part-timer holiday pay
Legally if a part time worker is averaging 42 hours a week for two years ( contacted for 25 ) are they entitled to increased holiday pay ? I know under this & previous agreements their contract should be reviewed every six month ,but we are going to go to disagreement about that .

Your holiday pay will be assessed on your contracted hours.

your holiday pay is on your contracted hours, but if you have been doing a lot more why havent you been made full time, the evidence is there

I'm in a similar position - I'm on a 30 hour contract and have been doing at least 39 hours for 6 months. I know it saves them money when I'm on leave & was thinking it fudges the figures on the number of hours is done in one office.

I would say you would have a decent argument for being paid a full-time holiday pay since you worked over full-time hours on the previous 12 weeks. The only problem is, our contracts are fixed hours and not shift work, so that may be their counter argument.

After six months of working hours consistently beyond the next step in contract hours, you should be getting a new written contract which will then give you improved annual leave/sickness pay.

A week’s holiday pay equals how much a worker gets for a week’s work (excluding non-guaranteed overtime payments in most cases)

This is why I said an argument could possibly be made. It does say "in most cases". If that were the case though, would the OPG in question be entitled to SA for those overtime hours?

Good Luck in your quest for FAIR Holiday Pay Lads.
I've often heard the "Average of the 12 Previous weeks argument being bandied about" and I believe one of our guys successfully argued his case. TBH over the years it's taken me enough time,and effort, to chase the overtime I've been owed (on a consistently regular basis). If had to start retrospectecly chasing holiday pay I think I'd lose the will to live.
It's just one of those stressful stupid things that you sometimes have to take on the chin....I know you shouldn't have to but RM really love shafting their employees over this dodgy holiday pay deal. Saves them MILLIONS!

I quite often do docket & usually most of it is ghosting - I know it's not right but I just think if this company is going to shaft me I might as well do it back.
