Wilful delay

Van sharing , partner had an accident trapped finger in van door just before our last loop . Very nasty injury , stuggled on and we managed to get one of our loops complete but partner was in agony. We took one loop back as we could not complete on time and also the injury.
Go back to office and been told conduct in the morning for wilful delay of the mail . As we did not phone to say we would not complete . Now i dont carry my mobile around with me and by rights we would have finished maybe just a little over our time today if it wasnt for the unfortunate accident. I have had next to nothing on PDA Training and was unaware that there was a phone facility on the PDA.

So can they conduct us for wilful delay??

I was concerned , my partner is the driver and im the non driver . I did ask i he was ok etc etc as it looked pretty bad. To be fair he soldiered on but obviously with an injury to the hand it must have been very difficult to say the least.

I just dont understand how we can be conducted for wilful delay , as this was an accident and im pretty sure it was not on purpose !
The duty were on is well known to be a bad duty and no one will sign for it or wants to work on it .
The duty is far too big , and we feel pressured every day to complete and today was also asked to flex , which we just could not do in our duty time . I informed the line manager that we wouldnt be able to flex today as at the time the manager was shouting around the office 'dont forget your flexing' so im also up for conduct for the way i spoke to the manager . Im like what ..? All i did was inform the manager we wouldnt have time to do the flexing.
Feeling scapegoated at the moment .

Cannot believe the way we have been treated today to be fair. Were both grafters if you like , dont mess around just keep our heads down and get on with it.
It seems that us not taking the extra work / flexing is an issue for management. There is no way on this earth either of us would wilfully delay mail , quite often we are 10 mintues over here and there and never book it as overtime.

Just dont need the hastle as obviously pal has an injury today this just adds salt to the wound.

No Accident on duty get the rep involved if you have one secondly your and his/hers safety comes first not your DOM's shoe ware issue or the lack of!

Get as much information to your rep, if it goes to fact finding make sure your copy of minutes is correct if not don't sign. Do not trust your Dom. I got dismissed for wilful delay , line manager packed my bags and several bundles were missing. Manager told lie after lie to protect his self. I'm going to a tribunal, though to me there is no case for you to answer to, that's what i thought!. Be careful

am i missing something ??? you cut off because you run out of time and your mate had a a.o.d. and you both getting done for wilful delay ??? sorry, but i cant see how you can be charged. hope it gos ok tomorrow and get all the help from the rep

he didnt follow the correct cutting off procedure, technically he could be conducted for that but pushing that to a wilful delay charge is far to much

You're under no obligation to use your own phone for work purposes. If they haven't given you the correct training to contact the office with the PDA then that's their problem. Do not go into the office for any meeting without a rep, if you don't have one at your office insist that one comes from another office or area rep, that too is your entitlement. Don't worry too much it's a scare tactic, place he blame firmly on the accident which means you couldn't have told them you wouldn't complete before you left the office as you was unaware that an accident was going to occur. Make sure your partner fills out an ERICA report and logs it in the accident book or there will be no record of it to back up your story.

if i do (again), the first thing i will be doing is going straight to the office to report it, not continuing on with my duty

If they haven't given you the correct training to contact the office with the PDA then that's their problem.

there is one thing with this statement though, if you have signed the PDA training documents then you have signed to say you have been trained properly in the use of the PDA including the phone function
