Notice and accrued holidays

Post by new2me »

A colleague wants to know, if he has 13 days annual leave owing to him, will he be paid 8 days of those if he hands his notice of 5 days in while on annual leave? Our contracts give me the impression that our notice is automatically extended to cover the holidays owed, but he says not. In previous jobs, i've been paid outstanding holiday entitlement on leaving, but am confused on this one

I'm not sure which you get but they are essentially the same thing anyway.

Yeah, thinking about it, it is.

But if he's made to take 13 days notice on leave, he cant take another job in that period? I'm probably making it more complex than it is and should tell him to carry on

He can take another job but he wont get his p45 if they pay the holiday after his last week.Just tell them royal mail are paying the outstanding holiday pay after the last weeks wages.
Id recomend going on a br tax code till the p45 arrives.
