Is this a reasonable adjustment? - your thoughts please
I used to have a delivery with some reasonable adjustments. I did not have to go into the office and my mail was brought out to me. I delivered with the aid of golf trolley and pouch boxes. All was well for 2 years then sadly this delivery was taken from me during the revision and I have been fighting ever since to get a similar arrangement agreed as I do not cope well with getting in and out of a van but I am otherwise fit and able to do a delivery.
To save myself from getting in and out of a vehicle too many times I need to go back to having the mail dropped at the beginning of my new delivery in the same way as before. I then only have two uncomfortable journeys to contend with - one from home to the start of delivery and one back home again - as I have done for the last two years. Returns/Specials etc would be handed to van driver in surrounding area at the end of delivery.
I could be dropped off by a friend or catch a bus to eliminate the 'using my own car' issue but DOM still says no. He know's I will have to give up if he carries on with his tactics and grievances are already in place but taking an age to sort out.
Just testing the water - does anyone out there think I am being unreasonable? Or is it a management thing?

If you've got all the right paperwork from doctors and atos etc you could fall under the DDA and Royal Mail have a legal obligation to find a job suitable to you as they cannot discriminate against you.

Also if you are an official case and Royal Mail would rather have you deliveryin than stuck indoors then they could have ring fenced that duty just for you. Check this thread for more on ring fencing.

All this was in place and they still took the delivery from me! Yes it should have been ring fenced but apparently it wasn't - planning team did not even know of my reasonable adjustments! I won the fight two years ago but now they got me again!
Still, moving on all I'm asking now is to be allowed to have mail brought out to me instead of going in to the office but getting nowhere!

They have a legal obligation to try. They don't have a legal obligation to succeed.coxie wrote:If you've got all the right paperwork from doctors and atos etc you could fall under the DDA and Royal Mail have a legal obligation to find a job suitable to you as they cannot discriminate against you.
Personally I think what you are asking for is reasonable.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

A colleague in a nearby town was practically crippled from repeatedly getting in and out of a van with a seat that was too low but is now fine in a van with a higher seat.

Tell them that you can't do it and if they don't like your proposal that you're open to hear what proposal they can offer you to help you do the job as comfortable as possible. I can't see the problem you're willing to deliver it's not like you're a lazy person who just wants to stay indoors.

Re: Is this a reasonable adjustment? - your thoughts please
You mention that you already have grievances placed concerning your current situation but not the level that grievances are at if stage 1, 2 0r 3 and at what authority level your grievances are being investigated as there is a time limit for receiving a response of 28 days or you have received written notification that the agreed time limit has been extended.
Having lost in a revision a duty which had reasonable adjustments made on the recommendations of OH Assist ( formally) ATOS then a similar duty with the adjustments that you require should have been automatically made available to you and in particular if OH Assist have stated that your condition falls within the DDA or the Equality Act 2010.
RM not honouring their own occupational health providers report and possibly breaching DDA/ Equality Act 2010 counteracts their claim that RM does not discriminate employees with a disability.
I suggest that you push your union rep further on action on your present grievances and at same time request a referral to OH Assist to have fresh reports and recommendations issued so that RM can ring fence a duty that meets your needs.

How many hours do you work? Who prepares your delivery? Why can you not go into the office? Are the changes due to a revision. We have had outworkers in the past but they were discontinued on revision as not an economical use of the workforce. The times are changing and we've all had to face them.

You say it all Rehabron so how does my DOM get away with it? Had OH Assist reports which back me up - Grievance been in (DSM) for two months - only had first meeting 2 weeks ago - told it was stage 2 - although I know the time limits have been broken I am trying to be reasonable - in the mean time they are offering me no solution. Really want to fill in that ET1 but trying to wait until they get back to me about the Grievance - No reasonable adjustments offered and Most definitely Discrimination but I just want to do my job - it's very frustratingrehabron wrote:You mention that you already have grievances placed concerning your current situation but not the level that grievances are at if stage 1, 2 0r 3 and at what authority level your grievances are being investigated as there is a time limit for receiving a response of 28 days or you have received written notification that the agreed time limit has been extended.

Maybe they could find you indoor work that would also be just 2 journeys , if you can't do the delivery the same way as everyone else this may be their only option , you still get to work your contracted hours and they have retained a willing worker , everybody wins , have you requested this ?

In the time honoured words of ATOS "this is ultimately and decision for a tribunal". That is should you wish to pursue the case and Royal Mail contest your case. Personally speaking i think that you could end up loosing hours if you are only able to do the delivery content of your walk, that is assuming that you are full time.
How about a bike as reasonable adjustment? That would throw the cat amongst the pigeons!
