What's the next step?

Post by on_the_way_OUT »

I'm formally appealing a 'Conduct Code' that I received last week.

Does anyone know what the procedure is? Who hears the appeal and are they generally known as fair?

My 'fact finding' was a hatchet job conducted by a manager that wants me out.

Union reckons it'll be a 1 or 2 year serious but definitely not the sack. What does this mean in terms of the future? How close am I to being out?
Cheers

Going by your posting you have only received your fact-finding interview and as yet not a formal conduct interview as you state that union reckons you will receive 1 or 2 years on your record
Not knowing what the charge is 2 years is a serious warning and your DOM has the authority level to issue a punishment of 2 years but not beyond and a punishment greater than 2 years has to be referred to a manager of a higher authority level.
If you feel that the fact-finding was a hatchet job and the interviewing manager issues a 2 year serious warning then you can appeal this decision and the appeals manger can uphold the decision, reduce the punishment or revoke the decision but CANNOT increase the punishment so it is well worth putting in an appeal as you have nothing to lose.
You are stressing yourself unnecessarily as you are nowhere near being sacked.
Consideration for dismissal is included in the standard letter but the merits of the case is paramount and you would basically be looking at a charge of gross misconduct such as dishonesty, wilful delay of mail, violence etc before you would contemplate looking for alternative employment.
Please post on the forum when you receive your official letter on what action is being pursued but you is possible disclose the charge so the best advice can be given.

Thanks a million for the reply it's much much appreciated :Very Happy

I've had 1 meeting to answer a charge of not maintaining a sufficient standard of work. Basically too many errors and complaints. Pretty standard postie fare.... a misdelivery here a missed scan there a bolshy customer complaining about not getting a 739 etc.

Got steamrollered in the first interview lino didn't want to know. Got a second letter stating I AM being taken down the CC and a meeting on Tuesday will enable me to argue my case. Thing is lino is is just going through the process. I WILL get the CC as DOM has said he wants me out.

I've been at RM for nearly 14 years and haven't been within 100 miles of the CC never even got a stage for time off. At 51 this situation and the possible consequences are pretty terrifying. :pray

On what you have now explained there is probably a requirement for counselling or retraining on the merits of the case or at worst 1 year on your record as a reminder to keep you up to RM standard but nothing more. I would certainly be lodging an appeal if there was a more harsher punishment for an independent manager to review the case.
Ensure that you have union representation at the conduct code interview when you complete the reply slip to the accompanying letter.
Would also at the CC meeting mention the fact of 14 tears service with an unblemished record at no stage warnings during the course of your service.
Speak to your union rep if he considers a grievance to be submitted against the actions of this DOM or better suited in the case of justice to use the appeals process.

Do you what the implications of a 'serious' on your record? Is it a case of 1 misdelivery and your out or it is it a bit more flexible? Not that I'm intending on making any mistakes but around here people like complaining ie I've seen misdelivery complaints where the address is correct but the name is wrong :(
