DDA in a resign

I don't know if anyone can help me here ....
we are having a resign in our office after our 2nd revision in 2 years.
There are a number of DDA's. I understand that duties will be ring-fenced for those with DDA's.
My question is ....if someone with a disability is 130 on the seniority list and there are only 120 duties, does that person leapfrog over
everyone else ?
This seems a little unfair to me, we seem to be discriminating against those that haven't got a disability

It all depends if their disability is a justified reason to be ringfenced.

I can see the reason for the ring-fencing if they are going to get a duty anyway, but feel that if they aren't then they shouldn't leap frog others.
RM should have to find work for them as a RTI

Duty should have been planned in the duty builder then ring fenced

If they don't "leapfrog", how do you fulfil your legal responsibility to make reasonable adjustments?
