I was an employee till 3 yrs back, no conduct issues employed 13 yrs, had a conduct issue put on me via a customer, managment went with customer side,police got involved via again customer not charged as was over 55p, managment knew on the day, first I knew was next day an hour into prep time I was informed by manager over it, tried with customer to sort the problem they wouldn't, carried on working for 3 days then was suspended seems strange if so serious an issue, so went to fact find managers broke data protection act in gaining evidence from customer, was then handed up to dsm was called to conduct meeting with a rep, I broke down had medical issues of own and wife all going on at time (cancer).LM knew all wat was going on with this...rep went to see dsm came back to me stating sack or resign, totally went to pieces and resigned could take no more..
After resigning wrote letter 5 days after to try and get job back answer came back no go.month after with union help sent another again dsm came back no chance .
Been in touch in the last 12 months with HR told by them I left under vol resignation only , tried for jobs back since had one with angard went pear shape when ex LM saw me work was pulled from me,I sent letter of complaint to HR this was backed upby a meeting with a manager but only LMgrade last summer, things he looked at were a waste of time all the answers he gave are the opposite what i have from doing my own digging via a SAR from rm.
Had job offer since this for xmas this was pulled from me 5 days prior to starting , and another for a contract job this was pulled 2 days prior to an interview stage..
Out of all this I made a claim against customer and won the case in court..

Legal team say can do nothing ,,,, R THERE ANY GOOD REPS OUT THERE PLEASE....I dont think this is so much a legal case more a grevience issue.. there must be some good reps that know

What was the conduct charge you were going to be charged with before you resigned?

What did you take the customer to court for?

How exactly did the manager break the data protection act?

3 of them deleted - all in the same forum. I am not a rep but could I ask you to clarify exactly what help you are looking for, I am afraid I struggled to understand everything that happened and what assistance you are asking for. It might also help get some more responses.

Your posting shows that you were persistent in your attempts to vindicate yourself from whatever resulted in the situation with the customer that also involved the police but you accepted the decision of a DSM stating " be sacked or resign" without allowing the conduct code to follow due process and if resulted in you being dismissed you could have taken to appeal stage and finally to an Employment Tribunal. Don't follow your argument that RM breached the data protection act unless you can be more specific.
To be suspended 3 days after the offence came to light I find this to be highly irregular as would have expected automatic suspension to follow in relation to the circumstances surrounding the customer which required police involvement.
RM suspension is in situations of dishonesty or to safeguard your working colleagues and you have not mentioned the full reason for the suspension.
You took the wrong decision in submitting your letter of resignation and I would be surprised if you have in writing the DSM comment of " be sacked or resign" and there you have nothing to substantiate your claim and therefore as HR has stated you voluntarily resigned even though you attempted to recover this after 5 days.
In relation to employment with RM through Angard I would have expected you to have been vetted and you would have had to complete a CV with your past employment history and I am surprised on this basis that you were placed with RM and had to encounter 2 rejections.
Having won your case in the courts and you must have been confident in winning then you should have used the same determination to prove your case at the RM disciplinary hearing and that's where you failed.
You have also stated a legal team having said no which legal team are you referring to (1) private legal team (2) CWU legal department (3) Employee Relations Team Sheffield.

Alleged theft of a bar of chocolate..

Defemation,lying on statment, non display of cctv posters ..

But wasn't able to do so till june 2011..

well its a bit two way the garage owners did as well on data protection as they allowed RM managers to view the cctv footage which the ICO state they should have who say that managers should have known not allowed to view, and if they didn't they ha ve plenty of departments that they could have asked ,,, ie security or ib....

Any help at all as at pres loads of docs gone to cwu legal team, who have now come back this week with a letter that was written on the 7 march yet I only received it on saturday last..I know mails slow but...they now say the legal team can do nothing , but could not the union in general? As stated I have had 2 SAR releases from rm on me the , last one which must be around 200 pages have statments of harrasment against me not going to put on here what , but one is that I in the last 12 months been to sheffield and pitched out side the doors....what where this came from but I do have it come back to me in document form etc etc......

why resign ? you should have sat at home and took wages every week

it was a cival case against them for defemation , lying on statment, non display of cctv poster as required under date protection
and yes I did get a pay out from them of compensation in 4 figures....

No I didnt this is why I went to cival court with it knowing I had left money for it and garage owners after all this were done for wasting police time ,, I was a copper also for 15 yrs prior to joining rm ,, my prob with rm was I couldnt get to court with cival case till june 2011..
they also lost a lot more than me when they had to pay me a 4 figure compo payment...
