As I understand it, its not the condition per se, but the effect it has on your daily life and how long its expected to persist.
For ease of reference the DDA was replaced by the Equality Act 2010 (but not the 2006 one)

You’re disabled under the Equality Act 2010 if you have a physical or mental impairment that has a ‘substantial’ and ‘long-term’ negative effect on your ability to do normal daily activities.
The Equality Act 2010 doesn’t apply to Northern Ireland - find out more on NI Direct..
What ‘substantial’ and ‘long-term’ mean
‘substantial’ is more than minor or trivial - eg it takes much longer than it usually would to complete a daily task like getting dressed
‘long-term’ means 12 months or more - eg a breathing condition that develops as a result of a lung infection
There are special rules about recurring or fluctuating conditions, for example, arthritis. For more details about the special rules download the ‘Equality Act Guidance’.

Arthritis is a fluctuating condition, so your needs may change from time to time. It is important to review your situation regularly with your employer and have a referal to occupational health for reasonable adjustments if necessary

OK thanks true blue much appreciated lets just hope my dim will sort my referral to ATOS as i did ask last time i was off sick and it didn't happen as was only off for 1 week thought id be OK now its more than likely ill get a stage 1 as will be of for a while as pain is all down me left side how long should a referral take

I have arthritis in my shoulder and have it in writing from atos doctor that I am covered under the equality act.

To a certain extent but if you keep going off sick they will want to get rid of you on IHR

This is interesting....I say that because I am deaf and I can't get my manager to make reasonable adjustments to my work place for me. Also manager told me I wasn't covered or entitled to DDA is this correct? And how do I go about getting something done about it ( in Northern Ireland) thanks

Your probably better going to the Deaf Association of Northern Ireland http://www.nicva.org/member/deaf-associ ... rn-ireland" onclick="window.open(this.href);return false; as they willhave experience of the particular issues and laws in the Province.
However, as a Layman I would say you would be covered under the NI equivalent of the EA2010 but only where your lack of hearing is an issue and where a reasonable adjustment is possible. For instance, delivering mail on the street, your condition means you are unable to hear anyone shouting at you, an unreasonable adjustment would be to ask you wear a sign announcing your condition. But in the office a reasonable adjustment MAY be installing a red light in your work area that activates when the fire alarm is activated.
Each and every case will have different merits and its impossible to say that one person with a condition will be entitled to adjustments, because another person with the same condition but in a different office and different environment and working conditions, may not.
Each case is different and each person/situation needs looking at individually.
