Touchy subject.

Was just wondering who has access to any paperwork with regards to DDA?
Who can view it?
Is it just the manager? Does everyone have to take their word for it?
Or can the Rep ask to see it?

There is a vacant duty, and the manager is saying that this one person has to have it as they need it under DDA.
It has a significant amount of allowances attached, so it is obviously unpopular.

So, is anyone allowed to see any relevant paperwork?
Or do we just have to live with it?

If you are asking if you, or anyone else without authority, can access or see proof of another staff members medical records then the answer is no.

The rep? Perhaps but not without that persons authorisation.

You are right, it's a touchy subject and I would be careful how you proceed or you could find yourself on the wrong side of equality laws if not.

If you do not have a need for a reasonable adjustment or special measures then you cannot possibly consider yourself discriminated against!

Well I'm with you rhino :cuppa I'm pretty sure if we tried hard enough we'd find something that allowed us to be given preference - and I had to look up LGBT :Very Happy

Not asking if the paperwork can be made visible to all.
Just want to know if the Rep has the right to see it.

The DDA procedure is quite large and extensive, and no one wants to view any personal information.
That said, there should be a 'official letter' in that persons file which states a start date of that cover, possibly including a basic outline of what they can't do.
This letter shouldn't include anything too personal or private.

Can't go into too much detail, but it has been going on for a couple of years, and the person in question has been getting most things their way using DDA.
We don't have an issue with a genuine case, but we have a very good reason to believe this one isn't.
The manager and this person are very good friends. And the DDA has been used to grant this particular person many things.
Even to the point that their personal position in regards of their issue has changed on more then one occasion, depending on what it is they wanted to achieve.

We know we have to be careful.
But if, as we suspect, the person isn't covered, they aren't likely to agree to the Rep seeing any information.
Which is why I'm asking if anyone can tell me if the Rep can ask to see the letter stating the person is covered.
And if refused, could the Rep argue against the person being given the duty, because they haven't seen the proof?

I doubt the rep can see it, the only chance would be if the person in question allowed it.

Then the rep wouldn't be able to tell anyone else the specifics only that it's covered.

The rep has no right to see the information without the express permission of the individual, it concerns their personal medical records and is highly confidential, under no circumstances can this information be given out to the rep with out the individuals permission,

The only route that could be considered would be for the rep to lodge a grievance against the person being allocated these duties you are unhappy about, and as part of the process the manager will need to confirm to the area manager that the person has in fact been assessed by ATOS, he wont need to confirm to the rep that that is the case and the reps neck would seerely on the line, as the only way that he would not be liable for a charge of bullying/harassment for the grievance would be if it was in fact correct

Not everyone who is covered by DDA will have a visible condition.
Many DDA conditions are 'hidden' but can be just as serious as a 'permanently damaged knee'
Just because there's no apparent disability doesn't mean that DDA doesn't apply.

I've been covered by DDA for 7 years but most people wouldn't know unless they have been told.

sorry but thats not right, but telling Postie B or the Rep the information that postie A has condition that is covered by the equality act to anyone without postie A's explicit permission is a complete blatant breach of the Data Protection Act,

That is of course their opinion so are you suggesting that it's carte blanche to ignore what are obvious issues in the workplace? The fact of the matter is that a delivery office has very limited scope these days to pander to those who cannot perform. So rather than tailor deliveries there should be room within the business to make room for genuine cases or make them an offer they can't refuse.
