Just thought I'd give an update on my situation from last year. I was dismissed in August last year for wilful delay, appealed and was told I had lost that at the end of October. I applied for an employment tribunal but for one thing or another the case was still in the processing stage as of Monday last week. not bad considering I applied back in November :roll:

At the end of January I had a call from my union rep asking me had I applied for an ET, told him what was happening etc and he said he was going to look into something for me. Within 2 days my case was reopened with royal mail, it turned out I had actually won my appeal back in October. My then manager did not like the decision and between him and his gaffer "got it sorted". It turns out my DOM at the time forged WTLL paperwork and my signature to get my appeal decision overturned with the help of his boss, only found this out as the DOM himself is now suspended and trying to drag everyone down with him.

Union backed me to the hilt and I can't thank them enough for all the support I've been given and issue was sent up to Dave Ward to make it a national issue, my office has also balloted for strike action after hearing what had happened to me.

Had a phone call last night though and I'm pleased to say royal mail have buckled. I should hopefully be back at my office on Monday and have 7 months back pay coming my way :nana

So anybody else that has had a rather dodgy decision go against them while suspended or during an appeal should get the union reps to double check everything as its clear royal mail don't mind breaking the law to get their own way.

Always uplifting to see justice prevail,let us hope the managers involved in this deception are fully held to account.

Hope you're still going ahead with the ET considering the stress and anxiety you must have been under.
These people should also be named and shamed.

I know I'm not the only one being looked into so won't name names just in case, the DOM has got the boot though but his boss has squirmed his way from suspension and is trying to be all pally with the union now.

could you say what part of country you are from curious i was dismissed for wilful delay back in 2010 managers including appeals manager all lied and colluded up to and through tribunal :shock:

Im in the West Midlands mate

The DSM that was involved though has worked around the country, it was his idea to falsify the documents but he has managed to keep his job for now.

It would be nice to think that RM hierarchy are coming down hard on all of these rogue DOMS DSMS, but it is refreshing to hear that justice has prevailed in your case :Applause :Applause

Would be great to know what part of law was breached as i had no less than 3 possibly 4 managers fabricate evidence as well as colluding between themselves.My dismissal was wilful delay ,amazing what a greivance can get you after 20 years clear conduct record :evil/mad

Brilliant news of outcome but would like to know if you won your appeal back in October why you did not receive a copy letter of the appeals manger's decision at the time. Make sure that your back-dated wages includes your holiday entitlements, supplements or scheduled attendance payments. A letter of apology would also be nice but I doubt if you would get it.

so its been proven that he was behind falsifying documents to get you the sack when you had won your appeal? if this is true why did the dom get the boot on his own & not both of them? & what are the cwu doing about this now you have your job back?
