Just some advice, been spotted driving without a seatbelt , now off duty is this a sackable offence. ? in this day of age.

Depends on context and history and who spotted you RM or police.

For a first offence, it is unlikely to be dismissal.

I do know people in my area that have been conducted for it, and given 2 year suspended dismissals.

It really depends who saw you. If it was the Police, and they issued you with a ticket, then you must tell your manager(and/or DOM) at the earliest opportunity when you are next in work. Inform the manager, take the Rep with you (fill them in before maybe), and see where it goes.

If it was the Police, and they didn't stop you/give you a ticket, then I'd guess you got away with it.

If you were driving down the road, and a manager saw you, then you will probably get a bollocking.
If the manager was on their own, they have no evidence, and so to pursue a conduct code case against you should be pointless (though lack of proof won't necessarily stop them).
Sometimes, I wish I wasn't a Rep.

You state you have been spotted not wearing your seatbelt. If its a case that a member of the public who has nothing better to do that report you to RM then there is the possibility that a ticking off from your manager may result. If its the police then manger could decide that you have already been punished and not raise through the conduct procedure. Would very much doubt if you have a clean record that this offence would warrant a dismissal or a suspended dismissal but manager as a warning may decide to place a punishment on your record.

The law is - you have to wear a seatbelt where one is fitted (unless medically exempt and another couple of bizarre get out clauses)
So why wasn't the person wearing a seatbelt?
Does the law not apply to them?

Can they prove they were seen committing the offence? If not they could sack you Clash, and me, or anyone really. Something is not right here.

No evidence required? Looks like RM DOMS are being asked to reduce the head count again.
