Unusual Question about Grievance

Hi Everyone

As you can see I'm new to posting on here but have been reading lots of topics with interest. Good to know I'm not the only person who doesn't have too positive an opinion about how RMG is managed.

Anyway, I've just instigated a grievance due to disability discrimination and a couple of other things. I know that this process is undoubtedly flawed and biased but my question is, has anyone ever raised a grievance over RMG's failure to carry out a grievance correctly? As I'm expecting delays and cover ups I was debating whether to then raise further grievances.

If you are going down the grievance route and they are dragging it out or abusing the system then of course you can then add farther complaints but you really should just take it to the next stage in the grievance route,i.e if you get no joy :hmmmm from your 1st stage then bring up the fact in your stage 2 which will then be heard by a further up the food chain manger,etc until you have exhausted the grievance procedure.

You can if you want to bury the feckers under loads of paperwork with more grievances if that is how you want to play it,it's up to you really :Very Happy ,but wear a tin helmet into work from then on.

Yes, I had such a problem. Grievance lasted 1year and 5 months. They try everything to wear you down and get you to give up. I named the bstrds that were delaying my process at each stage including HR. Went to appeal stage and even this was delayed and the result delayed, but I was determined not to cave in, and eventually got a partial result but very much begrudgingly given. Also notified Ms Greene of the delays and it did push things along a bit.

My grievance lasted 2.5 years. Went to stage 3. I naively thought that the further I took it the more likely a more competent manager would be put in charge, but no. Total whitewash and the delays undermined my case through lost evidence. In my opinion, the RM grievance procedure is more corrupt than a political election organised by Robert Mugabe.
What have I done to deserve this?

Hi Guys,

Sorry for delay and many thanks for taking the time out to reply. Have just started process but straight in at Stage 2 due to my grievance being with 2 managers, Atos and head of HR. Got meeting next week but not expecting much. Hopefully morr fuel to give to solicitor who is currently working on my ET case, with a big smile on her face :)

Can't believe that anyone senior in the company really know how appallingly bad RMG is run. If it was run by managers with half an ounce of intelligence then it would be so much more profitable and all our free shares would be worth £20 each lol

Thanks again for your input. Will play the grievance game but ET is where it's going.

I think you very much under estimate RM, not sure about your potential ET case but I'm not sure you really know what your doing!

Sounds to me that he is doing the right thing by taking this matter through the grievance procedure, but at the same time taking legal advice. I am sure his solicitor will be in a better position to advise him than you or I.

I think you very much underestimate the fighting spirit of the working man/woman.

If that person is in the right and knows it,and royal mail have unlawfully discriminated against him/her...then that person will have a very good case for success in an ET.

Well it seems that someone maybe underestimating me to be honest. I am far from stupid and also have built up a wealth of knowledge over the past year regarding employment law, the disability act and discrimination it the workplace. I have already challenged various people within the company to the extent that they have backed off and advised me that they don't want to be involved and that I should go down the grievance route. I have also spoken in depth to Equality Advice and Support Service (fantastic service) as well as an discrimination law specialist solicitor and they believe I have an incredibly strong case.

In addition to this, I know of a colleague who has taken them to ET 3 times on his own with no legal representation and won every time.

The problem with a lot of employees within RMG is that they don't have the balls to seriously challenge them. RMG is one of the worst run companies around and management is very much 'working class' management meaning that most of them haven't got the knowledge and understanding to work in any other way than through ignorance, bullying and harassment. Why do you think there are so many issues within RMG and why so many grievances and ETs are instigated? You just need to know that you are in the right and keep pursuing and you can and will win.

As has been said, we will see what the outcome is but I know that there have been serious failings in procedures, poor management and most importantly I know I have a very strong case of disability discrimination back up by law.

If you let us have the case numbers of the 3 ET's then I can look them up, to be honest I don't believe you, not many RM staff get one case upheld at an ET never mind 3. Once a case gets to an ET with RM very few get their job back.

Well I know from various sources that as far as the letter of the law stands I have been discriminated against under 2 aspects of the Equality Act.

Well it might be hard to give the Case Numbers for two reasons, firstly that the cases are a colleagues and so I don't have them and secondly on all three occasions RMG settled before it went to court. Don't believe me all you like but I know what the truth and reality is and I also know of another colleague who went down ET route and got a payout.

Sounds like you have had bad experiences but I know another reality from you.

The facts are in the ET case's, sadly RM is private now...................they must be so glad re the FOI act.
