Not knowing the exact reason for your sacking I am assuming by your posting it was in relation to your sick absences which have triggered a 3rd stage where dismissal is considered. In relation to your medical records held by your GP you would have been required to complete a form allowing your employer access to your medical records and only the medical conditions within the time period that brought about you triggering the 3rd stage and not your complete medical history. On RM referrals to ATOS and the information that you supplied they would have sent a report on their recommendations and any rehabilitation plan that was required. To dismiss you without having reports that according to you were missing and " not available in the system" then before any decision was taken the investigating manager should have ensured that he/she was in possession of all relevant documents before finalising a decision. I trust you had union representation at these meetings and on what you have stated you have been dismissed awaiting an appeal. If this is the case and knowing that appeals seem to drag on please ensure that if you are to bring your dismissal to an Employment Tribunal your ET1 must be submitted within 3 months from the date of your dismissal and only in exceptional circumstances can it be extended. Therefore don't wait for the appeal decision if close to the 3 months get your ET1 in. Good Luck.

Happened a couple of years ago now.
Won my job back then got IHR because whilst i was off my back went.

But i remember at the time vividly the boss saying "there is nothing wrong with you apart from stress.Your knee is fine according to atos".
So im asking the question.
Do royal mail managers or anyone else have access to the atos system?
How did the manager know i didnt get this report? or was he bluffing at the time?

I suspect he wasnt bluffing because person to person he had a weak persona and it would be a bit too easy to spot.
I think im a sound judge of a person and imo he was a bit over confident about how he went about that conversation.

So suspicions have got the better of me and i want to know LOL.

I'm not certain if they have direct access to ATOS systems but when I left in Sept 2012,my DOM was sent copies of all reports that ATOS sent to me so I would suggest that is how he knew about your problems.

My recent experience confirms that ATOS copy both you and your DOM in on any work-related health problems/injuries.

But if atos didn't send me one report in particular why was my dom so blaise that I just had stress and my knee was fine...I didn't need any adjustments on my duty?

He must have known that report was not coming to me....because it was in the report clear as day.

What arrangement do atos have regarding office space within royal mail property?
Ive seen an office before in whitechapel where I believe they have some sort of arrangement.

You have answered your own question. He did not need to make any adjustments to your duty so was easier for him to cover duties. He did not care either way as he was going to dismiss you anyway.

Maybe I haven't worded it correctly but my thinking is this.
He knew I wasn't getting that report for the phone conversation so could hide the fact that there were supposed to be amendments.
Remember this helped him sack me as had there been a report brought to the table he simply couldn't....my knee was hurting a lift was not working and I would have had to climb 4 sets of stairs to deliver....I tried the first set and there was a problem....the next large section of the walk I didn't have to climb id already done several hundred steps which tired the knee out and caused the problem....now considering I should have been on amended duties!!!!!!!!!
His whole argument was my knee was fine I had stress so it gave him the "reasonable assumption" argument in a tribunal....until the report turned up.

Even when the report turned up any reasonable employer would have backed out of the tribunal months before the re arrangement date because it was very clear they would lose.It would have saved them 4 months wages and the holiday accruement.
So on another point why did they not back out?
Did the people involved have something to hide?
Was getting rid of employees/ reducing the budget helping him/them financially in any way?

Put that together with the "knowing the report wasn't turning up" and the mystery losing of the reports on the system till I threatened to sue atos" you have to wonder if there is something fishy going on.
If someone had a contact within atos this sort of stuff would be easy to pull off.

But maybe its easier than that.

You would have been copied in to any of your reports from ATOS that were sent to manager making referral. If you felt that you were not in possession of a report that your manger had then you should have asked for a copy. You could have also written direct to ATOS requesting all your reports that have been sent to management. Doubt if RM would have direct access to ATOS system as the would leave themselves wide open for a breach of the Data Protection Act.

How do you prove a data protection breach?
I mean if someone looks at a screen and shares info there is no way me or you will know about it lol.
