My Royal Mail Contract

Post by snipanchor »

I have been at royal mail for Two Years in april, I have just been told by my union rep that it is possible that royal mail can basically let me go and then restart my contract again. So therefore (i will be basically on another 2 year probation i guess)

My question here is that at least 3 people came to the delivery office after me so surely they would be out the door before me?? as one of them has not even been here 6 months and a couple of them around a year. My existing contract actually is up for renewal in March before my 2 year period is up at the end of April, because of the way they have been giving 6 month contract then 3 month contract to me this is the way it seems to have landed!

I have not had 1 day off sick in this time, Never been late and basically done what they have asked of me for 2 years...any feedback on this would be great so i can get my facts right when this happens very soon and argue my case. :d'oh!

Although your rep has suggested that RM could do this, is there any clear indication that they intend to do it?
Why would they?
They don't legally have to offer you a permanent job until 4 years is up and the 2 year agreement with CWU is dependant on local factors anyway.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

No there is no clear indication, it was just a conversation in general i was having with them. There is know reason to do this has i say i have an excellent record since being there. What do you mean by local factors please?

If the office has had a revision, then the base staffing level should have been established and there isn't really a reason to keep anyone on a temporary contract.
If the office hasn't been through the revision process then people will be kept on temporary contracts until such time as the revision has been completed.
Unfortunately the appearance of TNT posties on the streets is going to make life a lot more complicated as the "model week" used in the revisions may well be taking a battering.

The 4 year period mentioned by " clashcityrocker" is the government legislation for fixed term/temporary contracts being on going for 4 years which if the case would automatically become a permanent contract and with all the employee rights that goes with it notice periods, redundancy payments and the right to an Employment Tribunal.
In the AFG&S agreement under section 2 " Legally Binding Undertakings By The Employer To The Union " under job resourcing and in particular section 2.7.6 No employee will be on temporary contracts exceeding 2 years and placed on permanent contracts giving redundancy payments and the right to take your case to an ET. " Clash City Rocker" indicating local factors is that within Section 2 of the AFG&S agreement is there would have to be " exceptional circumstances" in why temporary contract cannot be made permanent. What the " exceptional circumstances" are has not been made as usual abundantly clear but as already mentioned by " clash city rocker " your office maybe about to participate in a revision and you may have to await the outcome before contract is made permanent.
However as you are within grasp of your 2 years service this is where you have to do your homework and check duty lapsing, walk absorbing , uncompleted deliveries, sick absence and with the intervention of union rep argue your case why if it happens that RM has not extended your contract to a permanent. To give another temporary contract after March would indicate to me that there is work availably to give you a permanent contract and I would be making enough noise that can be heard in Moya,s office.
