IBS and Atos

I had a phone call from an Atos consultant this morning, I was asked a few questions about my IBS and medication. At the end of the short conversation, she said I was not covered by the equality act, I told her about the last two Atos reports and my GP saying I was covered, she said that would be up to a ET but in her option I was not covered in relation to my IBS, I told her the dom had asked for two other reports and because they supported me, he referred me back to atos to get a report that suits him, So if you have IBS be aware of this kind of behaviour by management and atos, I was diagnosed with a underactive thyroid last week and she said I am covered in respect of that. I would have loved to see the dom's face when he saw that, it would make it worth having this lump on my neck

until a week ago I didnt know anything about a underactive thyroid or the symptoms but I do now. If the medication works I wont need any modified duty in respect of a underactive thyroid but I still have IBS-C and because of those symptoms I do require adjustments. I posted this thread to warn other IBS suffers about the tricks management get up to.

With an "opinion" that your condition is not covered by the Equality Act, Royal Mail is under no obligation to provide you with a modified duty.

Weather my symptoms are caused by my underactive thyroid or my IBS only time will tell, from what Ive been told by my GP one disorder can fuel the other. So my symptoms will be covered by the equality act.

Hypothyroidism can be very debilitating actually like sleeping for 17hrs and feeling just as tired. It can actually require a modified duty.

If YOU are not satisfied with your Atos report, then request a re referral. IBS should be covered. We are starting to see DOM's trying this tactic often. Play them at their own game. If he refuses, consult your GB. Bottom line, do not let him get away with this.

I had hyperthyroidism for a couple of years before it was diagnosed and felt quite ill, eventually was taken to hospital a couple of times with a suspected heart attack before they discovered it was on overactive thyroid. Was treated with pills for nigh on three years before I had radium treatment to kill the thyroid and now take tablets to produce the necessary hormones.

You have to keep taking the pill but the symptoms go away so a modified duty isn't necessary.
In any case I'm not sure how you can tailor a duty to someone who feels tired all the time.
RM is under a legal obligation to TRY and create a modified duty. If it isn't possible .......

If, as is possible, the symptoms of IBS are fuelled by the underactive thyroid then that may also clear up with the thyroid medication.
Even if it doesn't then at the moment you no longer have ATOS confirming you are covered under the Equality Act.
And that isn't for ATOS or the GP to decide but will ultimately have to be decided at a tribunal.

Ive only developed underactive thyroid symptoms in the last few weeks, but Ive suffered with IBS for near 10 years, my GP said some of the underactive thyroid symptoms can fuel IBS but he is adamant a underactive thyroid is not the cause of all my symptoms and IBS is. This is just a case of management getting 3 atos reports that don't suit them and sending me back until they get the report that they want.
