At the start of the holiday year (april 2013) I was on a 25 hour contract which changed to full time in september. I never worked 25 hours I always worked 35+. I don't know how this effects my holiday entitlement. My contract said something about 4 weeks 2.5 days but pro rata for part timers. I've had 3 weeks off does this sound right?

I don't want to be conned out of holiday if I'm due more!!!

i would think holidays have nothing to do with overtime did you work a five day week ?

Legally the pay you get for your holiday should be pro-rata to the average pay you received in the preceding 12 weeks, excepting non-contractual o/t.
The number of days remains the same.
Example - today your manager asks you to go full-time for the next 12 weeks and you sign something - the weeks holiday pay you earn should be the same as those full-time 12 weeks.

Second example. Manager asks, weekly, on an ad-hoc basis you work full-time, nothing in writing. Your holiday pay stays at 25 hours per week.

Yes I worked 5 days a week and nothing was in writing for the overtime hours. So in this case I would still be due 4 weeks 2.5 days but 5 months of that entitlement would be at 25 hours and the rest at 39?

i dont think they are asking about holiday pay just how many days off

Should get 4 weeks and 2.5 days, pro rata to the % of the holiday year he has worked for the company. So if they where employed on April 1st they should get the full entitlement. However depending if and what rotation is in place t is possible that their entire leave allocation as been used booking 3 weeks leave due to it now being hourly based, ie a 3 on 1 off rotation requires 52 hours of leave time being used in order to book a week off. (basic entitlement is 175.5 hours)

i think this could be right make sure you get 4 weeks 2.5 days from this april did you have most of your time off after september ?

You get the same amount of weeks off no mater how many hours you work, BUT you only get paid at your normal week rate for your holiday pay. When I first started the manager tried to cut my holiday entitlement (less time off) because I was part time, work for no money. That was the start of bad times, till he left before he was asked to go.

Next year will be easier to keep track of as im full time now.

Point 2. Ring HR and ask them.

you should have had 22 and half days off, ignoring what hours you should have been paid on them, so you should have been able to take 4 full weeks plus 2 and half days extra

Yes always worked a 5 day week

I've only had 15 days so it does seem I'm due more. I will get onto it monday because I don't want to lose out.
