When a duty becomes available, I know you need to let the dom know if you want it but who gets chosen, is it on seniority?

14.4 Where a full-time post is advertised internally, it will be available to all full-time employees and part-time employees, who have opted for full-time employment, in that resourcing unit. The posts will be filled on the basis of ‘most senior individual’. Where a part-time post is advertised internally, it will be available to all employees as above and filled in the same way.

14.5 The resulting vacancy will be temporarily filled by a reserve, a surplus employee, a transferee from within the wider resourcing area or another resourcing area or by direct recruitment in line with the process above.

14.6 When the number of consequential vacancies in the resourcing unit reaches 5%, or after a period of six months following the last such exercise (if earlier), the posts will be advertised in the resourcing unit, en bloc and filled on the basis of seniority. If this results in any further vacancies, these will be filled, using the same process as above.

Can a senior Reserve employee insist of filling a vacant post prior to the post be put for application and selection to the wider/whole unit...

The reason I ask is that we currently have 'post' moves merry-go-round but the application notice and subsequent selection takes about 4 weeks and then about another 2 weeks before the move.

So we have 4 weeks or sometimes more where a duty is vacant but manager is just using all sorts of people to cover - including established walkholders who fancied a temp change, part timers filling for full time posts and vice versa and office staff and even putting such walks on OT...

Don't know about insisting on it.
But, the resulting vacancy SHOULD be filled by a reserve until such time as there is a new duty holder ready to start their new job.
The Rep needs to have a word.

We have about 8 full time jobs vacant and even more 30 hour jobs not filled.
These jobs are filled every day by reserves and people on overtime.
Loads of money is being saved by RM and or the DOM, less pension contribution, less delivery supplement, less holiday pay and whatever else.

How long is he allowed to do this? Is it possible the DOM has made extra bonuses or whatever by keeping people on shorter contracts and lessening THEIR bonuses and take home pay?

He could insist on covering the duty until the duty swaps are done and the final resultant vacancy is put up to be filled but cant insist that the duty is given to him on a permanent basis unless he is the most senior person in the office who want the vacancy,

When MC's have been closing, then there has been a ban (or at least that's what we were told) on letting PT staff picking into FT jobs, as they were needed to be kept vacant for any possible displaced staff.

its also worth using this snippet of the way forward agreement and lodging a disagreement if the DOM doesnt fill vacancies

What is meant by consequential vacancies? Is it literally every vacancy that has been failed to be filled?
