annual leave/ seniority

Hi guys/girls, I was wondering if anyone could help me out.
My company is using the seniority rule to allocate annual leave, which I have been told is illegal, and that RM used to do this until the law was changed? Can anyone enlighten me if this is the case and if so, how you are now allocated your leave?

We had to choose our first 4 weeks for 2014/15 back in September 2013 the rest go on seniority we were told once everyone has got their 4 weeks in

I believe the Way Forward Agreement covers your queries regarding the allocation of annual leave process. Offices have varying process which fit the terms of reference in the WFA. However, some offices might claim 'custom and practice' in the hope of preserving seniority as the sole arbiter. In these enlightened and equality times there are systems that offices can vote on which allocate annual leave on a fair rotational basis year on.

I think the longstanding practice of allocating leave on seniority was outlawed by some EC directive such that now instead it might be something like seniority for the first week, reverse seniority for the second week, etc. but it can be argued that that's not fair to those in the middle.
Royal Mail still uses seniority for repacking rounds after a reorganisation but that's because IN THEORY all rounds are equal.

Yes it was an eu ruling that changed the rules a female took rm to the court of human rights over it, so seniority was banned as such for holiday picks, but only on first pick, then it can vary as per your unit and what you have aggreed as a unit ..
