Hi guys very new to this site so sorry if this in in the wrong place. I emailed the union a month ago but never got a reply.
Basic rundown I was assaulted on post delivery (no fault of my own) September 2013 I had a witness but they have now pulled out and the guy has gotten away with it at the moment I am on the sick with depression anxiety and post traumatic stress disorder. Need less to say my managers have not been very helpful more or less hindering my return to heatlh. Question is they have tried to put me onto half pay as I have had 6 months off sick in the past year due to a knee operation and now this assault I have read that if you are assaulted on delivery you are entitled to full sick pay for a year?
Other question is I have been told by my managers that I am due 3 weks holiday and 1 lieu day which must be taken by April 2014 I will not be back to work by then so they have told me I will loose these even though 1 week is paid annual leave deducted from my wages weekly.
Could anyone let me know if this is correct or are they just trying to score 3 weeks holiday pay for nothing.

Sick Absence due to Assault on Duty
An employee who incurs sick absence directly due to injuries received in robberies or attempted robberies on Royal Mail Group, or from a bomb attack or assault on duty with no fault by the employee, will be allowed sick pay at the same rates as above, except that full rate sick pay will be provided should the spell of absence extend beyond six months (26 weeks). The entire period of such an absence will be ignored when applying the maximum limits on sick pay across any period of four years.

I have asked my manager to explain what the 4 years sick policy is on their legal agreement (attached) But they are refusing to tell me what it means.
I have rang a few departments up but they tell me this information is for managers only and to ask my boss to ring up so the information can be disclosed. My boss has told me to stop ringing up these people and will still not explain the legal policy as "its over his head"
Could you have a look at it as to me it looks like they cannot retire me as I fall into the assault 4 year sick pay category, needless to say this added stress is not helping me one bit.

For legal advice you need someone who is qualified to do so.
Do not use any advice on here, even from me, as gospel and legally correct without first talking to an employment lawyer.
However, the 4 year rule is in simple terms is if you go sick during a 4 year rolling period you are entitled to a total of 6 months on full basic pay. Everytime you go sick, then the number of days you were absent is taken from that 6 months pay entitlement.
If you are sick for 5 days, then 12, then 20, then 1 day in 4 years, and then sick for over 6 months, then you will be paid your basic wage for 6 months, less 38 days.
Do not use any advice on here, even from me, as gospel and legally correct without first talking to an employment lawyer.
