Seniority

Can anyone please help, my temporary contract started in November 2000, permanent one feb 2001, does my seniority start from November or February, I was told November but on my wage slip it says feb start date, I always thought temporary service has to be included, if so how do I go about getting it changed as we r about to have a resign in next few weeks, thanks

If you were an Xmas casual for November and then let go to be brought back in February then its definitely February - I was in that situation. If it was continuous service then I believe it may be from November - but I may be wrong.

It was definitely continuous service TBT, surely hr would tell me
And adjust it if necessary

I started as a casual, and my entry date was my first date of work.
i.e. includes my 'temporary' work time too.

Ring HR they should know, or else you DOM should be able to tell you from PSP.
I thought mine was going to be from when i was perm but it says on my holiday sheet and the seniority list the day i started as a casual on a 20hr contract.

From the Way Forward agreement:

13.6 All service within an appropriate grade, whether on permanent or temporary basis, will count for seniority purposes, with the exception of any periods worked on a casual contract, or during a career break or sabbatical. Unpaid leave will count provided there is no break in contract. Service after age 60 will continue to count. However service must be continuous for seniority purposes, with periods prior to any break in contract (due to re-employment, for example) not generally included, unless there are exceptional circumstances applying to particular cases that are agreed at local level.

The first seven months I worked (back in 1995/6) were as a casual and don't count towards my seniority. Most of my colleagues are missing six to twelve months of seniority for the same reason. However, I don't think the conditions we were employed under then would even be legal now so (e.g. no minimum wage, no paid annual leave). Therefore, casual service after those employment rights came in might need to be treated differently

Just spoke to hr, and they say temporary service does not count to seniority, can't believe this for a minute having seen the above in way forward agreement
