How does The Way Forward relate to a disabled person being redeployed under the equality act?

simple answer unfortunately it doesnt, a person being redeployed due to disability doesnt come under any national agreements as it doesnt have to, it overrides them it simply comes under the equalities act

I got a call from the area rep today, he said there is no chance of getting in to the MC on any shift, he went on to say there was a duty that could be tailored to my needs, in a van on my own, he said the dom, me and the rep would sit down and agree and sign a plan when I was happy. He said there was a repick in a few months and I could see about an inside job then or stay on the tailored duty. Yesterday I put in a H1 email against my DOM and I got a call from the gateway team this afternoon, I am to hear from an external manager who will hear my case. (posted on blue shirts)

you know from what youve been saying here and your other post i am going to give you a piece of advice that i have never done before and probably wont again, your union rep and the mail centre rep seem to be dead against you getting into the mail centre they seem to want to stop you getting inside and against the recommendation from atos, see when you have that meeting with the DOM, i would not be bringing the union rep in with you, leave them out of it, you dont need them fighting their own case in your meeting, if you want you can still bring in another colleague as a witness but i think you should just leave the union reps out of it

i would still advise contacting linda roy at CWU HQ though and i think you might find she will move things along in the correct way

I put a complaint in about a rep a while ago, the rep dealing with me is his mate, It looks as if they are closing ranks.

the rep said Linda Roy was only advisory.

She is only advisory but then again so is the rep, and the advice she will be giving is a dam sight more accurate with regards to equalities act than they seem to be

Definitely sounds that way, i would even maybe suggest a quiet word with the DOM before the meeting and ask him if he foresees any problems with a redeployment to the mail centre, could be he is getting pressure from the union and would be worth while you knowing that

I had my ISA Friday, the day before I got a call from my area rep telling me, he and the DOM had a meeting and can make a outside duty for me, tailor made to fit my needs, and there was no hope of a transfer, I said I wanted to wait for the ISA to be done and see the report. The ISA recommends redeployment, he said breakdown of employee-management relationship or something like that, I cant remember. I know there are 20 full time duties on nights at the MC and only 4 have been taken, the MC are having trouble finding 16 others who want nights. Looks to me its a done deal before the ISA report was done.

i would be going over the area reps head now if i was you asking exactly why he thought he had authority to go and have a meeting with the dom and discuss your health/duty etc without your knowledge

I got a letter from the OPERATIONS MANAGER today asking me to come in for a meeting , I email him saying I was too ill but he could come to my house, I just got a email from him saying he will come to my house Thursday or Friday to discuss the contents of the ISA and the way forward regarding your long term absence. Any advice?

my normal advice would be to agree to it but make sure your union rep was there to, but because of what you have been telling us what union rep and area rep have been upto i would advise against it, i would agree to the meeting and maybe ask a trusted colleague to attend as well as a witness.

i would also stick to your guns, if you want whats been recommended in the ISA, then stick with asking for that and agree to nothing else, remember the law is on your side, they cannot insist on IHR if there are already recommendations for redeployment from the Occupational provider without being at risk of losing a big employment tribunal
