Overpayment HELP

Someone in my office is having a problem and not sure what to do so i thought i'd see what you guys thought. Before Xmas they were told that they owed RM about £1600 for being paid sunday premium for 3 years from when it stopped instead of 1 year and 17 weeks which is what they were apparently only entitled to (despite being told 3 years ago that everyone would get 3 years money). However after talks with the union the MCM then sent an email to the union rep and told them that this would be waived as it was completely the fault of RM and agreeing that there was no knowledge on behalf of the postie they had been overpaid so all was well. But then last week there was money taken out of the posties pay without them being told prior that this would happen and the MCM turned around and said HR have said that they are going to be taking back all the money no matter what, so given that the MCM had agreed to waiver this overpayment where does the postie stand now? Any thoughts?

Did you get anything In writing about this over payment being written off on the previous occasion?

There is an overpayments policy that hr SHOULD adhere to, should be discussion with postie and line manager as to how to pay it back and if they cant reach an agreement then I think the policy states 10% of weekly wage till its all paid back.

3.6 Royal Mail's policy is to seek recovery of overpayments of pay by agreement, wherever possible. However, Royal Mail reserves its statutory right to deduct from salaries any monies owed. The CWU notes it is Royal Mail's policy to reclaim overpayments of wages in these situations by deducting 10% of the individual's gross basic pay per pay period until the overpayment is fully recovered. This will be a last resort and only applied after all reasonable efforts have been made to reach an agreement with the employee concerned. Royal Mail commits to dealing with overpayments in a reasonable and sensitive manner and with due regard for individual circumstances throughout the period of the overpayment.

4.6 In instances where an employee has left the business, Royal Mail will seek to recover any overpayment. As soon as an overpayment has been established People and Organisational Services will notify the ex-employee concerned. This notification will clearly detail the amount of the overpayment, the circumstances that have led to it, and the options available for recovering the monies that have been overpaid. Debt recovery will be used in instances where reasonable efforts have been made and failed to reach an agreement on repayment of the overpayment.

They don't have to accept anything.
They can take the default 10% from your wages or if you no longer work for the business they can use a debt recovery agency.
Obviously if you ain't got it though they can't have it but that's a different ball game.

I'm talking about leavers and a debt agency,not the RM peeps.

There fault been paying £20 a month for overpayment of driving allowanceTold them it was all i could afford after they sacked me.Two managers told me i was entitled to it they have to acept any reasonable offer.Its nearly 4 years on still paying £20 a month overpayment was £2, 800
