Dom has threatened to stop my pay whilst on sick

I'm on sick covered by my doctor. Doctors sick note still covers me for two more weeks. Got letter from Dom saying I have to return to work tomorrow or my pay will be stopped. Can he do this.? ATOS have said I'm fit to return to work with my job adjusted as suggested by Dom. I've made another appointment to see my doc again to see if he agrees.

but can my Dom actually stop my pay if I don't go in tomorrow ?

Hope someone can help me. I've told my rep, heard nothing yet.

depends on what is wrong with you, but if I were you I would ask him/her to sign a statement that if you have a relapse on return then not only will you not be subject to a second absence but you will have a good case for a claim of harm/injury caused by a forced return to work against your gp advice

Thanks spilie. He won't be in tomorrow , it's Saturday. So I don't no what to do. I don't think I'm fit for work, my doctors sick note says I'm not. Can he and ATOS override my doc? And stop paying me?

As is often the case many DOMs and Linos are making it up as they go along to fill in staff shortages as cheaply as possible while protecting their bonus and no scrutiny from Area over under performance. they are in breach of the agreement to treat all absence as genuine, Doctor's notes is a legal document, no one can over ride a GP medical advice if they are not medically qualified to do so.

it's in your contract that you should be paid sick pay.
It's against the new attendance procedure for them to just stop your pay.
And lastly no he can't stop your pay just because he,or Atos disagrees with your GP.
And yes they like to bully people back to work as NWest postie said which was supposed to be stopped under the new attendance procedure but obviously hasn't and these clowns think that this new agreement will see management and the union working more closely.....not a chance and just goes to show you how out of touch the HQ lot are.

I've just spoke with my rep who has advised me not to attend work in the morning as the doctors note still stands. And he has pushed it up to area rep. My only worry now is, if he does stop my pay from tomorrow onwards I will have no wages for the length of time it takes to get sorted. Doms letter says he's following procedure and cos ATOS say I'm fit to return, if I don't then my continued absence is unorthorised and my pay will be stopped immediately .

If an employee's contract says payment for sickness absence is conditional on management being satisfied the sickness absence is genuine,it is for the employer to make the decision as long as it is in good faith and not perverse.The employer cannot just decide the absence is not genuine without any specific evidence to that effect and merely because the employer's occupational health service disagrees with the employee's GP as to when the employee will be fit to return.

But surely my Dom would have been told by his boss and someone has said do it. I mean someone up he ladder. Why would they do that?
