Just after a bit of advice for a colleague.

Last week another driver noticed tax disc in a van was out of date by a few months, my friend who uses the van for his duty hadn't noticed it was out of date and I guess to be honest I myself personally would only know when my tax is due to be out of date on my own car when the tax disc reminder comes in post.

Basically it turns out van is taxed but tax disc either gone missing or was never put in the van nobody really knows.

So anything likely to happen?

It is the drivers responsability that the vehicle conforms to statutory requirement. The vehicle may well have tax but the driver can be held accountable and fined for failing to display. You need to take the vehicle off the road and request an allternative.

If you choose to drive your vehicle on a road without displaying a valid tax disc then you commit an offence and risk getting fined

Yes they could possibly take him down the conduct code as checking the tax disc is part of your vehicle checks, it would depend on how reasonable your managers are

but your legal responsible for a vehicle you drive on the road, so by you driving it on the road and not displaying a tax disc you are breaking the law, not the van manager

Also just check the drivers manual, checking your tax disc is part of the duty checks:

Duty checks (inside the cab)
• Completion of logbook
• Seat belts (operation of)
• Fuel level (ensure sufficient for duty)
• Brake pedal movement/operation (static check)
• Handbrake movement/operation (static check)
• Horn (operation of) but consider operating times
• Operation of windscreen wipers and washers
• Steering (free play)
• Cleanliness of vehicle and windows (inside)
• Operation of heater/demister
• Dashboard warning lights.
Duty checks (walking around the vehicle)
• Condition/cleanliness of all glass, including mirrors
• Lights and lenses (operation, condition and security)
• Doors (security)
• Tyres’ visual check (pressure, tread and sidewall)
• Vehicle excise duty (correctly displayed and in date)
• ‘No Smoking’ sign (correctly displayed and of the correct type
for your office)
• Visual inspection of wheel nuts and indicators (where fitted)
• Condition of number plate bodywork and attachments
• Cleanliness of vehicle (outside)
• Signs of oil/coolant/fluid leaks (report on PMT1 if anything found)
• Load, including security and condition of restraint straps/system
• Operation and security of tail lift (where fitted).
Additional duty checks for LGVs
• Trailer connections (suzies)
• Fifth-wheel connection and safety chain
• ‘O’ Licence disc displayed
• Trailer tail lift power lead (where fitted)
• Trailer lights
• Trailer number plate
• Trailer leg stowage
• Vehicle height displayed/set in cab
• Side guard and under run protection equipment (>3.5 tonne vehicles)
• Wheel torque indicators (>3.5 tonne vehicles).

Daily checks
• Engine oil - all plated vehicles and light vehicles (top up if required
and report on PMT1 if this has fallen below the minimum level)
• Coolant (top up if required)
• Brake fluid level (visual check – report on PMT1 if level is low)
• Screen washers (top up if required)
• Signs of: oil/coolant/fluid leaks
• Service/inspection due reminder sticker, date and mileage entered.

Weekly checks
• Tyre pressures and tread depth (using gauges)
• Engine oil - all unplated and low-mileage vehicles only
(top up if required).
Details of any damage or faults with the vehicle identified upon
takeover must be recorded in the Vehicle Condition & Mileage
Logbook (P1061E/PFU89).
Where damage is not previously mentioned in the logbook, it must
be referred to your manager before taking the vehicle onto the road,
and the logbook should be counter-signed by your manager for
future reference.
Always check to ensure a sufficient level of screen-wash fluid is in
your vehicle. In adverse weather conditions, a method to de-ice
your vehicle will be provided by your manager. Never drive a vehicle
where you cannot clearly see all of the road ahead

from this October no worries on that score as no disc will need to be displayed on vehicles so u wont know if van is taxed or not unless this is for private cars only

Had the same thing, vehicle was taxed but they couldn't find the disc, so told DOM I would not drive that van till they found it, so they gave that van to someone who would drive it with no tax disc, three weeks later when they found the disc I got that van back.

So no longer will a manager be chasing round with a new tax disc trying to find me at 6am on the first day of its validity.
