On speaking to my dom today in regards to atos authorising (not) more physiotherapy as suggested by my physio, he asked me have i thought about the future and if my injury prevents me from completing my normal duty, he has in the past said their will be no amended walks available if that was needed and said have i thought of moving to the nearest mailcentre.

To be perfectly honest, i do not know what functions they or i could perform their, so couldnt answer if it would be suitable, as well as this the mailcentre is 18 miles away in another city which would take a lot longer to get to compared to my current office, Id rather not do this as it would obviously cost me more to travel, take longer and I would be working indoors permanently and possibly shifts/nightwork i imagine.

Basically could i be forced to undertake a totally different job in a different city, rather than him find me a duty more apt to my injury, ie a rural round with less walking?

i just told my boss i would not be going anywhere and to find me a job that i would be ok on which he did :nana :nana

as i understand it from previous posts, the injury is not one currently being considered as one that would be covered under the equalities act as its been diagnosed as possibly getting better in the next few months so as such that limits what your dom has to do for you, at the moment he is not legally obliged to "make reasonable adjustments" under the equalities act

so he can ship you out or send you home sick unfortunately

so how does this work with conditions covered by the equalities act? i have IBS and diagnosed depression and have been told by Atos that this is covered so if I really struggle after xmas (when put back into reserve floatation with daily struggle to find a toilet on a duty) i can "demand" the DOM creates a job for me in my office?

Royal mail are legally obliged under the equalities act to make reasonable adjustments to accommodate your illness, for someone suffereing from IBS that may mean giving you regular duties as a floater where frequent toilet stops have been identified or even putting you in the locker

Thats fair enough and at present im in the locker which even though its not light duties, someone is needed in the locker and its a compromise, he was referring to moving to a mail centre permanently.

well my reply would be that as you dont have a permanent disability then no chance, (if you did have a condition covered under the equalities act then you might have trouble fighting that as it would be a reasonable adjustment)

and coupled with the fact that atos dont think its going to be long term due to not authorising physio he is going to struggle to do that, i would even say if he says no more indoor duties suitable then you should go sick until the injury has fully healed

Just a quickie, the physio is obviously in the same time my normal current working hours are, do i have to work additional hours to match my weekly contract, ie my hours are 10-5 and physio is usually around 3.30 - 4 for an hour, my boss is making me return back to work or come in early, it is fair i suppose but a bit pathetic.

Depending on the nature of your knee injury, clambering in and out of a van may be just as demanding on your knee as walking. The Atos advice to continue your physiotherapy is the right call in seeing how your injury responds to the treatment. If there is indoor work available at your DO and it does not compromise your treatment your Rep does have a case to keep you at the DO. It is far too early in the treatment to just off-load you to a mail centre as the Dom will need to justify his action and not just on his say-so. Depending on the nature of job you get at a mail centre it may still involve a lot of walking so provision would have to be made for that. You could also claim that you would find the move stressful and not helping with the recovery process in anyway.

Speak with your Unit Rep/Safety Rep. Failing that, ring your branch and seek advice from there. If you are not a CWU member I would suggest you join asap, if only so you are not fighting your corner alone.

If you cannot change the physio appointments to outside your normal working hours, it is not your fault. In those circumstances you are entitled to work the hours you are contracted to do (10-5) and are not required to come in early to compensate for the appointment. And, yes, your Dom is just being pathetic in asking you to return to work following the physio. I would argue that coming back to work would undo the benefit of the treatment. Speak to the physio and get them to write a letter stating the effectiveness of the treatment would be undone, or at the very least treatment prolonged unnecessarily. Always create paper trails, keep note of appointment times, discussions with the Dom, etc as they can always be used at a later date if required to strengthen your case.

if he is wanting you to then yes if you want paid as he could say take it as unpaid leave instead, unfortunately again if your injury was covered under equalities act then you would have a case to get the time off but as its not he can insist you make the time up

My contracted hours are 7.50 - 3 varying slightly each day, but im 10-5 to cover the den whilst in supposed recovery.

Thats fair enough i just think its quite pathetic, and i offered to come in early to fill the gaps in the hours as the hospital is on my way home anyway, now im going to be driving back and forth for no reason in my mind, but can see his point and its not a major issue.
