Amended Duties, as per GP.
Returning soon from a back injury, the GP has highlighted the Amended Duties aspect of the new Sickeness/Return to Work form.
Does anyone know what the Precise meaning of this is re: Royal Mails guidelines?
Obviously, "heavy lifting" is out of the question currently, so does not handling a 9kg bag or 11kg sack constitute Amended Duties?
Its very vague.

its not just as simple as ticking amended duties, doctor needs to put down what activities you should not be doing, if he has just ticked amended duties and not said something like refrain from lifting, then dom can unfortunately expect you to do pretty much your duty until medically told otherwiseThunderthighs wrote:Returning soon from a back injury, the GP has highlighted the Amended Duties aspect of the new Sickeness/Return to Work form.

Yep, I've had the John "SHAFT" treatment previously!
The Doc mentioned not lifting/carrying...so if it good enuff for her, I'm gonna "mention" it too...once or twice...or maybe three times!
Colleague came back too soon, back troubles. They had him covering EVERYTHING. Now off Long Term. Not good.

In our office 'light duties' translates to callers office.
More walking, lifting, bending, etc

Unfortunately not that simple now, if it doesn't state what you can't do then Dom doesn't medically know what you can't do so he can get you to do pretty much normal duty, the fit note needs to say what you have not to do, he doesn't need to take your word for it unfortunately, I would get back to docs to sort out the fit note

Manager should refer you to ATOS who will interview you over the phone and assess your capabilities. Be straight with them, they have always been pretty fair (unless you're on sickness benefits
).
They will write a report of what you should and shouldn't do, and any amendments to your hours that are necessary for a phased return. This report will go to your manager and a copy to you.
Tell your manager you are able to return to work once you have made arrangements with ATOS.
You may need to let your union rep see a copy of the ATOS report if the manager tries to 'rush through' the timeframes they recommend, which is fairly likely.

On the other hand, it does not follow that an employer will be deemed to know about the disability just because the employee has said that he thinks he is suffering from a particular condition, or his doctor has diagnosed him as such, without providing any further medical evidence. In the latest judgment from the EAT on this issue, the case of Cox v Essex County Fire and Rescue Service, Mr Cox had informed his employer that he was suffering from bi-polar disorder, but this was never properly confirmed to the employer by medical evidence (not least because Mr Cox would not agree to the disclosure of his medical records). The Tribunal held, and the EAT agreed, that the employer did nothave actual or constructive knowledge of the disability. This may seem surprising at first glance, given that Mr Cox had clearly set out in writing to his employer the dates, symptoms, likely trigger and detailed effects of the condition, but the Tribunal did not look at that fact in isolation. The employer, having been put on notice by the employee of a possible disability, asked “all the right questions” – it obtained occupational health reports, sought medical opinions on whether the employee was disabled, tried to get a report from the employee’s GP (which was refused by the employee), and sought a formal diagnosis of the condition. Despite all this, there was no indication, other than what the employee was telling them, that the employee was disabled.

I was initially told, "Atos will be in touch, as its a sprain/strain/musculoskeletal injury. I have to refer you."
When they didn't contact me, I enquired by phone to our office as to why. No definitive answer was given.
Subsequent conversation leaned more towards "They may be contacting you soon..."
Two weeks later, still no Atos contact at all.
So, the balls in their court, as in, the Atos thing.
Defo a call to the GP Monday now then...
